<br />In the matter of the estate

<br />1,Now, on this 6th day of September, 1929, upon due application therefor, the hearing in the for -
<br />"going matter was continued on account of litigation pending in the District Court of Hall Counl'y,
<br />;Nebraska, involving the title to the real estate belonging to the said estate, and thereafter u1
<br />!continued from time to time until the lat day of June,1931.
<br />NON, on June 1st, 1931s the said matter came on to be heard before the Court, upon the petitio
<br />of David C.Gideon, the order of the Court for notice of heating the proof of publication of
<br />notice of the hearing upon said petition, and the Answer of William H.Gideon and others to sai
<br />petition, thereupon evidence was duly introduced, and the said matter submitted to the Court.
<br />The Court, being fully advised in the premises, finds that due-and legal notice has been given
<br />to all persons interested in the estate of the said James S.Gideon,deceased, as required by
<br />law, and the order of the Court, that the allegations of the petition of David C.Gideon are
<br />true, that the said James S. Gideon departed this life, intestate, on March 7, 1919s then
<br />being a resident and inhabitant of Hall County, Nebraska, and the owner in fee simple of the
<br />south half of the northwest quarter and the north half of the southwest quarter of Section 150
<br />Township 9 North, Range 10 West of the 6th Principal Meridian, in said county, leaving as his
<br />only surviving heir at law, one Jacob M.Gideon, his father, the mother of the said James S.
<br />Gideon having preceded him in death, and the said James S.Gideon leaving no widow or child or
<br />children or other heirs surviving him.
<br />The Court further finds that more than two years had elapsed since the death of the said James
<br />S.Gideon prior to the filing of the petition herein, and that no application has been made or
<br />filed for the administration of the estate of the said James S.Gideon,deceased, nor has his
<br />estate ever been administered upon in the state of Nebraska, or elsewhere; that all claims
<br />against the estate of the said James S.Gideon have been barred by lapse of time, and that the
<br />said petitioner, David C.Gideon is now the owner of an undivided one -third interest in and to
<br />the said real estate, derived by him from and through the said Jacob M.Gideon.

<br />The Court further finds that upon the death of the said James S.Gideon, the real estate herein
<br />described, owned by him at the time of his death, passed and descended, under the intestate
<br />laws of the state of Nebraska in force at the time of the death of the said James S.Gideon, to
<br />Jacob M.Gideon, the father of the said deceased.
<br />IT IS, THEREFORE, ORDERED AND DECREED that it be judicially established and recorded that the
<br />said James S.Gideon died intestate as aforesaid, a resident of Hall County, Nebraska, being
<br />then seised of an estate of inheritance in the real estate herein described, and leaving the
<br />said Jacob M:Gideon as his only heir at law, who, as such, inherited the said real estate in
<br />fee simple; that more than two years have elapsed since the time of the death of the said
<br />James S.Gideon; that no administrator has been appointed or any other proceeding had for the
<br />administration of the estate of James S.Gideon,deoeased, in the state of Nebraska, or elsewher#;
<br />that all claims against the estate of James S.Gideon are wholly and forever barred, and that tie
<br />said David C.Gideon is now the owner of an undivided one -third interest in and to the said real
<br />:state, derived by him from and through the said Jacob M.Gideon.
<br />IT IS FURTHER ORDERED AND DECREED that the said real estate, to -wit: the south half of the
<br />northwest quarter and the north half of the southwest quarter of Section Eighteen (18), Townsh1p
