NJ., 5 HALL � � UN'liY <br />11the funeral expenses and all debts of said deceased have been fully paid, and if any debts <br />',:exist against the estate of said deceased, the same have long since been barred by the statute <br />'of limitations of the State of Nebraska; that the estate of said deceased is not subject to <br />;any Federal estate taxes or any inheritance tax of the State of Nebraska)- and that the petitior. <br />its entitled to a decree and order of the Court as in her petition prayed; that the costs of thi <br />,,proceeding in the sum of $25.34 have been paid. <br />'IT IS THE SFORE ORDERED, ADJUDGED AND DECREED BY THE COURT, that Kuhneudank Schultz died in- <br />'testate on December 91 1926; that at the time of her death she was a resident and inhabitant <br />',of said Hall County; that she left surviving her as her sole and only heirs at law, her three <br />;daughters, Carrie Runge, Barbara Hilton and Cora Warren; that the degree of kinship of said <br />a <br />,;heirs to the deceased is that of children; that at the time of her death, the deceased was <br />'seized of an estate of inheritance and was the owner in fee simple of an undivided one - twelfth <br />i <br />,interest in the real estate hereinbefore described, situated in Hall County, State of Nebraska, <br />said undivided one - twelfth interest in said real estate passed and descended on her death to <br />Carrie Runge, Barbara Hilton and Cora Warren, her children in fee simple, share and share alike <br />That the petitioner at the time of filing her petition was the owner of an estate of inheritanc' <br />in said undivided one- twelfth interest in said real estate, and was a competent and proper per-; <br />son to prosecute this proceedings; that more than two years have elapsed since the death of sat <br />i!Kuhneudank Schultz; that no application has been made in the State of Nebraska, for the appoint,- <br />;went of an administrator of the estate of the deceased, either by her heirs or by persons clam <br />ling to be creditors of said deceased; that the funeral expenses and all debts of said deceased <br />have been fully paid; that the costs of this proceedings have been fully paid; and that the <br />i <br />estate of said deceased is not subject to Federal or State inheritance taxes. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT, that all debts of said Kuhneudank <br />jSchultz, if any such exist, are forever barred and precluded and that the undivided one- twelf# <br />linterest in said real estate hereinbefore described be and the same is hereby set off and <br />assigned at the death of Kuhneudank Schultz to her three daughters above named, in fee simple,1, <br />I <br />share and share alike, and that the estate of said Kuhneudank Schultz, deceased, is hereby <br />forever settled and closed. <br />Paul N. Kirk <br />County Judge. <br />SUPPLEMENTARY FINDING <br />The Court further finds from the evidence, and it is further adjudged and decreed that the <br />correct spelling of the name of said deceased is Kuhneudank Shultz; that said deceased was th <br />widow of Charles Shultz,deceased, who took title to the premises hereinbefore described by <br />warranty deed from Frank H.Penny, dated February 13, 1902,recorded in Book 34 of Deeds, at <br />4 <br />Page 86, in the office of the register of deeds, of said Hall County,and'is the Kuhneudank <br />!i Shultz referred to in the will and decree in the estate of Charles Shultz,deceased, recorded <br />j i in Book 4 of Wills and Decrees, at Page 265, in the office of the register of deeds of said <br />Hall County, and that said Kuhneudank Schultz and Kuhneudank Shultz are one and the same per- <br />son, notwithstanding the discrepancy in spelling. <br />Paul N.Kirk <br />County Judge <br />STATE OF NEBRASKA ) In the County Court of Hall County, Nebraska. <br />HALL COUNTY SS.
