That he died intestate; that the said Walter Churchwell inherited from his fathj <br />a 6ne -third interest in Lot 3, of Block 5, College Addition to the city of Grand Island,Hall <br />County, Nebraska; and that James S.Churchwell,his brother is his only living heir at law, and ' <br />that title to the above mentioned real estate has passed absolutely in fee simple to James S. } <br />Churchwell as the sole heir at law of the said Walter Churchwell, deceased, under the statutes.'l <br />of the State of Nebraska. <br />i <br />The court further finds that the estate of the said Walter Churchwell,deceased, was not subject <br />to any inheritance tax under the laws of the State of Nebraska and the said administrator has <br />paid all of the debts of said deceased, and that no claims have been filed against said estate, <br />and that the costs of administering the said estate have been paid by the administrator and <br />said estate should be closed and the said administrator discharged. <br />3 <br />The court further finds that due and legal notice has been given to all persons of the time and <br />°i <br />place fixed for filing claims against said estate and that said time so fixed has fully expirejd <br />and all persons having claims against the estate of the said Walter Churchwell, if any, such <br />there be and not fixed therein, are forever barred and precluded from setting up or asserting <br />any claims against said estate. <br />The court further finds that the said Walter Churchwell deceased, did not have personal property <br />i. <br />w <br />H� <br />
