Court further finds that under the terms and provisions of the last will and testament of

<br />!jby absolute title, and in equal shares, to Harry Grabach, Effie Guile, and Lynn Gemberling, son,
<br />land daughters of said deceased, subject only to the life estate devised to Mary Cleveland
<br />Grabach, surviving widow of said deceased; that the said Mary Cleveland Grabach, surviving widow
<br />-`of said deceased, is now dead, and the life estate devised to her under the last will and testa;-
<br />,ment of the said Henry Grabach, deceased, in the real estate hereinbefore described, has thereby
<br />terminated and the title to said real estate has become absolute in the said Harry Grabach, Effie
<br />;Guile, and Lynn Gemberling, son and daughters of said deceased, and that the petitioner herein
<br />','is the owner of an undivided one -third of the real estate hereinbefore described and is a com-'
<br />petent person to prosecute this proceeding.
<br />IT IS, THEREFORE) ORDERED, ADJUDGED AND DECREED BY THE COURTthat the said Henry Grabach departed
<br />:this life on the 25th day of January, 1913, and at the time of his death the said Henry Grabach
<br />was a resident and inhabitant of the county of Sandusky in the state of Ohio, and that he left':
<br />;surviving him, as his heirs at law, legatees, and devisees, and his only heirs at law, 1egateeo,
<br />and devisees, Mary Cleveland Grabach, his surviving widow, Harry Grabach, a son, Effie Guile
<br />and Lynn Gemberling, daughters, all of whom are of legal age; that on the 3d day of February,
<br />1913, the last will and testament of said Henry Grabach, deceased, was duly proven, allowed, ?i
<br />,and admitted to probate in the Probate Court of the county of Sandusky in the state of Ohio,
<br />and that said court was the court having original jurisdiction of the allowance and probate of�

<br />copy of said last will and testament, together with the probate thereof, duly filed herein, be
