<br />,the last will and testament of Henry Grabach, deceased, late of Sandusky County in the state of
<br />',Ohio, and one of the owners of the northeast quarter of Section 13, in Township 11 North of Ra+e
<br />10 West of the 6th Principal Meridian, in Hall County, Nebraska, praying for an order of Court
<br />'fixing the time and place of the death of said Henry Grabach, deceased, and for the allowance
<br />;and probate of the last will and testament of said deceased as a foreign will, for a determine-1�

<br />tion of who were the heirs at law of said deceased, and to whom the real estate hereinbefore
<br />ddescribed, owned by said deceased at the time of his death, passed and descended, and for a
<br />;settlement of the estate of said deceased, and the Court, having examined the records and file
<br />herein, and listened to the testimony in support of said petition, and being fully advised in e
<br />.,premises, finds that due and legal notice has been given to all persons, including heirs at la
<br />,'legatees, devisees, and creditors, of said deceased, of the time and place fixed for a hearing
<br />flu P on said petition , by P ublication in the Grand Island Daily Independent) a legal newspaper
<br />':published in and of general circulation in Hall County, Nebraska, as heretofore ordered by th
<br />Court.
<br />The Court further finds that the said Henry Grabach departed this life, testate, on the 25th
<br />day of January, 1913, a resident and inhabitant of Sandusky County, in the state of Ohio, and
<br />that he left surviving him, as his heirs at law, and his only heirs at law, Mary Cleveland
<br />Grabach, surviving widow of said Henry Grabach, deceased; Harry Grabach, a son of said. decease ,
<br />Effie Guile, the petitioner, a daughter of said deceased, and Lynn Gemberling, a daughter of
<br />said deceased, all of whom are of legal age.
<br />The Court further finds that by consideration of the Probate Court in and for the county of
<br />Sandusky and state of Ohio, and being the court having original jurisdiction of the allowance
<br />and probate of the last will and testament of said Henry Grabach, deceased, the last will and
<br />testament of the said Henry Grabach, deceased, was duly proven, allowed, and admitted to probate,
<br />on the 3d day of February, 19131 and that a duly authenticated copy of said last will and testi-
<br />!meat of the said Henry Grabach, deceased, together with the probate thereof, by the Probate C
<br />I�
<br />of the county of Sandusky and state of Ohio, has been duly filed in this Court and cause, as
<br />for the last will and testament of the said Henry Grabach, deceased, and that said last will
<br />and testament of the said Henry Grabach, deceased, is entitled to and ought to be allowed and
<br />admitted to probate by this Court as and for the last will and testament of the said Henry
<br />t
<br />Grabach, deceased, the s&id Henry Grabach having died as the owner, by fee simple title absolu�e,
<br />of the following described real estate situated in the county of Hall and state of Nebraska,
<br />to -wit: The northeast quarter of Section 13, in Township 11 North of Range 10 West of the 6th
<br />Principal Meridian, in Hall County, Nebraska, upon which said last will and testament of the
<br />I
<br />said Henry Grabach operates.
<br />The Court further finds that said last will and testament of the said Henry Grabach,deceased,
<br />was duly executed by the said Henry Grabach as required by law, and that at time of making sai
<br />will said Henry Grabach was of full age, of sound mind and memory, and not under restraint, an
<br />was in all respects competent to devise real and personal estate; that more than seventeen ye s

<br />have elapsed since the death of the said Henry Grabach, deceased, and no petition has ever bee
<br />filed in the state of Nebraska for the allowance and probate of the last will and testament o j
