<br />Now on this 18th day of September,1930, the same being the day previously set for the hearing
<br />of this cause, this cause came on for hearing upon the petition of John B.Rose filed herein for,
<br />determination of heirship of Josephine Rose, deceased, and the court being fully advised in the'
<br />premises finds:
<br />That all notices have been given and proceedings had herein as provided by law; that the facts.::

<br />!set forth in the petition of the said John B.Rose filed herein are true; that Josephine Rose
<br />died intestate on the 30th day of July, 1928, then being a resident and inhabitant of Hall
<br />County, Nebraska; that more than two years have elapsed since the date of her death, and that
<br />no application for the appointment of an administrator of her estate has been made by any hems
<br />or persons claiming to be creditors of said decedent; that said decedent at the time of her de *th

<br />.was the owner in fee of real estate situated in Hall County,Nebraska and described as follows,:,,
<br />to -wit: Block 14, and the West -half of Block 15, in Pleasant Home Subdivision of Part.of the
<br />i
<br />East -half of the Southeast Quarter of Section 21, Township 11, North of Range 9, best of the
<br />6th P.M., in Hall County, Nebraska;
<br />that the said Josephine Rose at the time of her death left surviving her a husband, John Rose,
<br />and the following children: John H.Rose, Phillip J.Rose, Lillian Rose,Clara Kalafat and
<br />r
<br />Lucy Harley, all of whom are over the age of 21 years; that the above described real estate
<br />during the life time of the said Josephine Rose constituted her homestead, which was occupied
<br />as such by the said Josephine Rose and John Rose, her husband, for some time prior to and at
<br />the time of the death of the said Josephine Rose. Ij
<br />The court further finds that all claims,debts and expenses of the estate of the said Josephine)
<br />"Rose, deceased, have been pai d and satisfie d , and said property above described descended freeil �
<br />of all debts against said estate; that there is no inheritance tax due in this estate.
<br />IT IS THEREFORE ordered, adjudged and decreed by the court:

<br />That regular administration of the estate of Josephine Rose, deceased, be dispensed with; that!,

<br />the real estate above described be and the same is hereby assigned to John Rose as his home- l
<br />,i
<br />stead, and that the said John Rose have possession of said homestead so assigned during the
<br />bt
<br />term of his natural life; that the real estate above described be and the same is hereby assigned
<br />to 'John Rose an undivided one -third interest therein, and to John B.Rose, Phillip J.Rose, Lil an
<br />�f T
<br />Rose, Clara Kalafat and Lucy Hurley, and to each of them, an undivided two- fifteenths_intereoI
<br />therein, said interesta to be subject to the homestead of the said John Rose.
<br />It is further ordered by the court that all claims, debts and expenses of the estate of the
<br />said Josephine Rose, deceased, have been paid and satisfied, and are forever barred, and that!;

<br />there is no inheritance tax due in this estate.
