0 <br />AM YJ EA-11 VIDN197 <br />IN WITNESS WHEREOF I have hereunto set my hand and affixed the seal of the County Court this <br />_22nd day of November 1929. <br />(SEAL) <br />IN THE COUNTY COURT OF HALL COUNTY NEBRASKA. <br />!'IN THE MATTER OF THE ESTATE ) <br />OF <br />ELMER E.HUYCK,DECEASED. <br />'Now.on this 31st day of December 19291 <br />F I N A L D E C R E E <br />J.H.Mullin <br />County Judge. <br />j <br />this cause came on for hearing on the final report of j <br />Orland T.Huyck, Executor of the last will and testament of Elmer E.Huyck, deceased, and the <br />court having examined the records and files and being fully advised in the premises finds that <br />due and legal notice has been given to all persons interest in said estate of the time and <br />place fixed for hearing on said report as heretofore ordered by the court, and the court having; <br />examined the final report together with all other files and the testimony offered in support <br />thereof finds that said report is true and correct in all things and ought to be allowed and <br />approved as and for the final report of said executor. <br />The Court further finds that said Elmer E.Huyck departed this life on the 3rd day of October, <br />i <br />1928 in Hall County, Nebraska, and on said.date he was a bona -fide resident and inhabitant of <br />said County. <br />• 'I <br />The Court further finds that on the 17th day of October, 1925, Orland T.Huyck filed in this coulrt <br />his duly verified petition praying for the allowance and probate of an instrument purporting t <br />be the last will and testament of the said Elmer E.Huyck,deceased, and the court thereupon fix <br />the 13th day of November, 1928 as the date for_ making proof of said last will and testament an <br />that due notice of the filing of said petition and the time and place fixed for hearing was <br />given as by law provided and on said date, the 13th day of November, 1928, said instrument was <br />duly proven, allowed and admitted,to probate in this court as and for the last will and testa <br />ment of the said Elmer E.Huyck,deceased, and Letters Teatamentary were duly issued thereon to <br />Orland T.Huyck,Executor, as named in said last will and testament and he thereupon qualified <br />such. <br />The Court further finds that due and legal notice has been given to all persons of the time <br />place fixed by the court for the filing of claims against said estate and that such time has <br />fully expired and all persons having claims against said estate, not filed herein, if any such <br />there be, are forever barred and precluded from setting up or asserting any such claims against <br />said estate. <br />The Court further finds that the said Elmer E.Huyck left surviving him as his sole and only <br />heirs -at -law the following named persons,to -wit: Orland T.Huyck,Laura Johnson and Beatrice <br />Melin, and that said heirs -at -law are the sole and only devisees and legatees named in said <br />Last Will and Testament. <br />The Court further finds that the said Elmer E.Huyck died seized as the owner in fee simple of <br />the following described real estate,to- wit: Lots 4 and 5 in Block 38 in Russel Wheeler's Addi- <br />tion to the City of Grand Island,Hall County,Nebraska; An undivided one -half interest in Lot <br />in Block 38 in Russel Wheeler's Addition to the City of Grand Island Hall County,Nebraska; one <br />cemetery lot in the Grand Island Cemetery,Lot 149 Section "D". <br />The Court further finds that said estate was not subject to inheritance tax under the laws of <br />the State of Nebraska. <br />The Court further finds that said Executor has paid the funeral expenses and all other claims <br />Filed against said estate and the expenses and costs of administering said estate and has made; <br />
