'Now.on this 31st day of December 19291 F I N A L D E C R E E J.H.Mullin County Judge. j this cause came on for hearing on the final report of j Orland T.Huyck, Executor of the last will and testament of Elmer E.Huyck, deceased, and the court having examined the records and files and being fully advised in the premises finds that due and legal notice has been given to all persons interest in said estate of the time and place fixed for hearing on said report as heretofore ordered by the court, and the court having; examined the final report together with all other files and the testimony offered in support thereof finds that said report is true and correct in all things and ought to be allowed and approved as and for the final report of said executor. The Court further finds that said Elmer E.Huyck departed this life on the 3rd day of October, i 1928 in Hall County, Nebraska, and on said.date he was a bona -fide resident and inhabitant of said County. • 'I The Court further finds that on the 17th day of October, 1925, Orland T.Huyck filed in this coulrt his duly verified petition praying for the allowance and probate of an instrument purporting t be the last will and testament of the said Elmer E.Huyck,deceased, and the court thereupon fix the 13th day of November, 1928 as the date for_ making proof of said last will and testament an that due notice of the filing of said petition and the time and place fixed for hearing was given as by law provided and on said date, the 13th day of November, 1928, said instrument was duly proven, allowed and admitted,to probate in this court as and for the last will and testa ment of the said Elmer E.Huyck,deceased, and Letters Teatamentary were duly issued thereon to Orland T.Huyck,Executor, as named in said last will and testament and he thereupon qualified such. The Court further finds that due and legal notice has been given to all persons of the time place fixed by the court for the filing of claims against said estate and that such time has fully expired and all persons having claims against said estate, not filed herein, if any such there be, are forever barred and precluded from setting up or asserting any such claims against said estate. The Court further finds that the said Elmer E.Huyck left surviving him as his sole and only heirs -at -law the following named persons,to -wit: Orland T.Huyck,Laura Johnson and Beatrice Melin, and that said heirs -at -law are the sole and only devisees and legatees named in said Last Will and Testament. The Court further finds that the said Elmer E.Huyck died seized as the owner in fee simple of the following described real estate,to- wit: Lots 4 and 5 in Block 38 in Russel Wheeler's Addi- tion to the City of Grand Island,Hall County,Nebraska; An undivided one -half interest in Lot in Block 38 in Russel Wheeler's Addition to the City of Grand Island Hall County,Nebraska; one cemetery lot in the Grand Island Cemetery,Lot 149 Section "D". The Court further finds that said estate was not subject to inheritance tax under the laws of the State of Nebraska. The Court further finds that said Executor has paid the funeral expenses and all other claims Filed against said estate and the expenses and costs of administering said estate and has made;
