<br />ion to said estate is not subject to any inheritance tax under the laws of the State of Nebras
<br />that the deceased died seized in fee simple of the Southwest
<br />p Quarter (SWJ), of Section Twenty -
<br />i eight, and Lot One (1), on the Island in the Southeast Quarter (SEJ), of Section Twenty -nine
<br />ii (29) all in Township Eleven (11), North of Range Nine (9), West of the 6th P.M. and that the
<br />same was devised to her three sons William Hagge, August Hagge and Fred Hagge, share and sharel
<br />alike charged with the payment of four legacies of $3000.00 each to the four daughters of the
<br />testatrix, namely; Adele Petersen, referred to in the will as Adela Peterson, Emma C.Behrens,
<br />Helen M.Roby and Clara Hagge; that each of said legacies has been paid in full and that the
<br />lien and charge on the lands above described for the payment of said legacies has been release
<br />and discharged and that said land descended in fee simple under the terms of the will and the
<br />statute of wills of Nebraska, to William A.Hagge, August W.Hagge and Frederick J.Hagge, as
<br />tenants in common; that the deceased died seized in fee simple of the East Half of the North-
<br />west Quarter (EJ NWJ). of Section Twenty -eight (29), in Township Eleven (11), North of Range

<br />Nine (9), West of the 6th P.M., excluding therefrom the land conveyed prior to the death of
<br />the testatrix as follows: Commencing at,the lortheast corner of the Northwest Quarter of Secti
<br />Twenty- eight, running thence South along the center line of said Section 91 rods; thence West
<br />parallel with the center line of said Section 79 rods; thence North parallel with and two rods!

<br />East of the West line of the East half of the Northwest Quarter 66 rods; thence East at right
<br />angles 416 feet, thence North 241 feet to the North line of said Section, thence East to the
<br />place of beginning; and excepting the rights of school district No 1 of Hall County, Nebraska,
<br />in about two acres in the Northwest corner described in Book F at page 170 and Book 8 at page
<br />633 of the Deed Records of said Hall County; and that the same passed and descended under the
<br />terms of said will and the statute of wills of Nebraska, to Clara Hagge, her daughter and to
<br />her said sons William A.Hagge, August W.Hagge, and Frederick J.Hagge, referred to in the will
<br />as William, August and Fred Hagge, as tenants in commom subject to the condition that the same)
<br />shall be kept as home for the four devisees above named and shall not be subject to a forced
<br />sale, partition sale or other sale by judicial proceedings so long as any of said children
<br />are alive and unmarried; unless all four of them are willing and consent and should any one or
<br />more of said. four children sell his, her or their interest while any of the four children rema�n
<br />unmarried, the use, enjoyment, rents and proceeds thereof, shall vest in and belong exclusively►
<br />to the rest of the four devisees above named who have not sold or conveyed their respective in ereste
<br />i
<br />therein as long as they or any of them remain m=arried; that the testatrix also died seized
<br />i
<br />in fee simple of fractional Lots Six (6), seven (7), and Eight (8), all in Block One Hundred FIrty-
<br />eight (148), in Union Pacific Railroad Company's second Addition to the City of Grand Island,
<br />in Hall County, Nebraska; and that the same passed and descended under the last will and testa�ent
<br />of the deceased to Clara Hagge; that all legacies have been paid; that all personal property
<br />i
<br />belonging to the deceased has been disbursed and distributed in accordance with the last will
<br />and testament; that the estate has been fully administered and is hereby settled and closed
<br />and the executors discharged of their trust.
