<br />WILL, CERTIFICATE AND FINAL DECREE:
<br />Y LAST WILL AND TESTAMENT OF CAROLINE S.HAGGE.
<br />I, Caroline S.Hagge, of Hall County, Nebraska, being of sound mind and memory and considering
<br />is
<br />I; the uncertainty of life, do make, publish and declare this to be my last will and testament,
<br />:i
<br />li hereby revoking all former wills by me made, that is to say:
<br />Item One: I direct that my just debts and the expemses of my last illness and burial be first
<br />paid.
<br />Item Two: I give and bequeath to my four daughters, Adela Peterson of Davenport, Iowa, Emma ii
<br />Behrens of Hall County, Nebraska, Helen Roby, whose address is Iliff, Colorado and Clara Hagge,
<br />�i
<br />of Hall County, Nebraska, each the sum of $3,000.00 and I direct that these legacies to my
<br />daughters, aggregating $12000.00 (Twelve Thousand Dollars) shall be paid not later than one
<br />year after my death and shall bear interest at the rate of six per cent per annum commencing 11
<br />�i
<br />one year after my death unless sooner paid. I further direct that these legacies shall consti_�i
<br />tute a lien and charge upon the farm land devised to my sons as provided in Item Three hereof.!
<br />Should any of my four daughters die before me, leaving no descendant or descendants, her or !I
<br />i;
<br />them surviving, then the $12,000.00 above bequeated shall be divided equally between the survii-
<br />Ere of my four daughters.
<br />Item Three: I give and devise to my sons, William Hagge, August Hagge and Fred Hagge, equally,
<br />or to the survivors of them if any of my sons die before me leaving no descendant or descendan
<br />him or them surviving, the Southwest Quarter of Section-Twenty -eight (28) comprising about
<br />152 acres and Lot number One (1) on the Island in the Southeast Quarter (SEJ) of Section Twen
<br />nine (29) all in Township Eleven (11), North of Range Nine (9) West of the 6th P.M., laid Lot
<br />One (1) last mentioned containing about 7.80 acres and the whole containing approximately
<br />159.90 acres, all subject nevertheless to a lien and charge of $12,000.00 for the payment of t
<br />four legacies of $3,000.00 each to my four daughters Adela Peterson, Emma Behrens, Helen Roby
<br />Clara Hagge as provided by Item Two to be paid by my said sons as soon as they conveniently
<br />may and within one year after my death if they accept the devise subject to the charge. It is
<br />wish that my said sons should accept the devise and continue their farming operations, paying
<br />their sisters the legacies above provided. Should my sons decline to accept the land above
<br />devised, which constitutes all of my farm land, except the home forty acres hereafter devised,
<br />I direct that my executors shall sell the land above devised at public or private sale, as soo
<br />as practical and upon such terms and conditions as to them shall seem best, without obtaining
<br />any order or license of any court or judge and to execute, acknowledge and deliver deed or
<br />deeds of conveyance therefor and I provide that the purchaser thereof shall not be be required
<br />to see to the application of the purchase money as hereinafter provided. If my said sons shall
<br />not have elected to accept the devise within a year after my death, I direct my executors shal
<br />sell the same as soon thereafter as they deem advisable and direct that outof the proceeds
<br />of the sale my executors shall first pay the four legacies to my daughters provided for in
<br />Item Two and shall pay the balance after deducting costs and expenses of sale, to my sons
<br />shahe and share alike, in lieu of the land.
<br />Item Four: Subject to the restrictions hereinafter contained, I give and devise to my said
<br />daughter, Clara Hagge and to my said sons, William, August and Fred Hagge, my homestead embra Ing
<br />about forty acres of the Hagge farm, where the home and buildings stand, described as the Eastl

<br />Half of Northwest Quarter (E2NWJ) of Section Twenty -eight (28), in Township Eleven (11) North
<br />of Range Nine (9) West of the 6th P.M., excluding therefrom the land heretofore conveyed and ich
<br />does not belting to me, viz: commencing at the Northeast corner of the Northwest Quarter of
