<br />LAST WILL AND TESTAMENT OF JAMES HERSHEY.
<br />IN THE NAME OF GOD, AMEN
<br />I. James B.Hershey of , in the County of Arthur, State of Nebraska, being
<br />of sound mind and memory and considering the uncertainty of this frail and transitory life, do!
<br />therefore make, ordain, publish and declare this to be my last WILL AND TESTAMENT.
<br />FIRST, I order and direct that my Executrix hereinafter named, pay all my just debts and fun-
<br />eral expenses as soon after my decease as convent$ntly may be.
<br />SECOND, After the payment of such funeral expenses
<br />my beloved wife, Augusta Hershey, all my property,
<br />I shall die seized and possessed, unto her and her
<br />my property of any and every nature whatsoever, of
<br />upon my death pass to and become the property of m
<br />and debts, I give, devise and bequeath unto'i
<br />real, personal and mixed,remaining, of which
<br />heirs forever, my intention being that all
<br />which I shall die seized and possessed, shall
<br />ii
<br />y b loved wife to use and dispose of at her
<br />Will.
<br />In making this will, I am not unmindful of any of my children of my body begotten, who would
<br />be heirs of my said property were this will not executed by me, and in excluding them from this
<br />my last will and testament, and from sharing in my said property, I do so knowingly and inten
<br />tionally, and with the intention of having all of my said property pass to and become the
<br />Droperty of my said beloved wife, upon my death.
<br />LASTLY, I make,constitute and appoint my beloved wife, Augusta Hershey to be Executrix of this!
<br />my last Will and Testament, hereby revoking all former wills by me made, and it is my request
<br />that she be not required to give bond as such executrix.
<br />IN WITNESS 'WHEREOF, I have hereunto subscribed my name and affixed my seal, the 20th day of
<br />July, in the year of our Lord, one thousand nine hundred twenty -five.
