<br />;That the executors have waived and released in their capacity both as executors and trusteed al
<br />!the rights and authority given them as such executors and trustees under Clause "Third" of the
<br />,Will of said John J.Fitton, deceased, to manage and control the real estate of the decedent in
<br />the State of Nebraska, and that all things necessary to be done to complete full administration
<br />of.the estate of John J.Fitton, deceased, have been fully done and performed.

<br />That on the 25th day of January, 1930, the executors herein filed their final account, and thatil

<br />said account is a true and correct account of all their receipts and disbursements as such
<br />executors, and that they have fully accounted for all personal property of said estate which hays
<br />come into their hands or under their control,, and.that the charges of said executors for die- jl
<br />buursements are all just and legal charges; that there is no balance in the hands of said execut!brs
<br />for distribution; and that said account should in all things be approved.

<br />That John J.Fitton, deceased, left no widow surviving him, and left surviving him as his sole ;1
<br />and only heirs at law the following named persons,to -wit : - Russell A.Fitton, a son, Henry R.
<br />Fitton, a son, John M.Fitton, a son, Catherine C.Sullivan, a daughter, Berner rd J.Fitton, a sorb,
<br />William R.Fitton, a son, Edward P.Fitton, a son, Robert Fitton Sears, a grandson, and Janet Sups

<br />a granddaughter, said grandchildren being the children of a predeceased daughter,

<br />That John J.Fitton, deceased, dies seized of the following described real estate,to -wit:- the
<br />East Half of the Northwest Quarter (*NWJ) of Section Thirty -four (34), Township Thirteen (13)1'

<br />North, Range Eight (8) West of the 6th.P.M. in Merrick County, Nebraska; the Northwest Quarter;j
<br />(NWk) of Section Twenty -five (25), Township Eleven (11) North ,Range Eleven (11), West of the
<br />6th P.M. in Hall County, Nebraska; and the Northeast Quarter (N *) of Section Thirty -two (32)
<br />Township Twelve (12) North, Range Eleven (11) West of the 6th P.M. in Hall County, Nebraska;
<br />that under the terms and provisions of the Last Will and Testament of said John J.Fitton;
<br />deceased, an undivided one - eighth interest and share in said real estate has been devised to
<br />each of the following named seven children of the deceased,to -wit, Russell A.Fitton, Henry R.
<br />Fitton, John M.Fitton, Catherine C.Sullivan, Bernard J.Fitton, William R.Fitton, Edward P.
<br />Fitton, and an undivided one- sixteenth interest and share to each of the following grand chil-
<br />dren, Robert Fitton Sears and Janet Patricia Sears, they being the children of a predeceased
<br />daughter of said John J.Fitton, deceased, and taking the share of their mother.

<br />IT IS THEREFORE CONSIDERED, ORDERED AND DECREED by the court that the accounting of the execut4�rs,
<br />Henry R. Fitton, John M.Fitton and William R.Fitton, be and hereby is approved; that the title'
<br />tb7th,e real estate above described has descended to and is hereby assigned to the seven ehildr n
<br />above named an undivided one- eighth each and to the two grand - children above named an undiviOd
<br />one - sixteenth each, as tenants in common; that administration herein be and hereby is closed, �nd
