<br />110, North, of Range l0a West of the 6th P.M., Hall County, Nebraska, and the fast Half of the iI
<br />Southeast Quarter of Section 17, in township 10, North, of Range 10, West of the 6th P.M.,
<br />'Hall County, Nebraska, and also Lot Numbered Six (6) of the Southwest Quarter of Section 28$ in
<br />township 10, North Range 10, West -of the 6th P.M. Hall County, Nebraska, by the terms and pro-
<br />lions of the last will and testament of the said John Beberniss, deceased, passed and deso
<br />!to George Beberniss in fee simple, to have and to hold to him and_his heirs forever. -
<br />The court further finds that the East Half of'the East Half of the Northeast Quarter of- Seetii
<br />24; in township 14: North, of Range 161 West of the Indian Meridian, Ouster Oounty, Oklahoma,
<br />passed and descended to Charles Beberniss, by the terms and provisions of the last will-and
<br />testament of the said John Beberniss, deceased, in fee simple, to have and to hold to bin and
<br />his heirs absolutely and forever.
<br />The court further finds that all elaims.against said estate have been paid, including funeral
<br />expenses and costs of this proceeding, that the inheritance tax fixed by this court to be paid
<br />by Robert Beberniss and George Beberniss has been paid into the County Treasury of Hall County,
<br />Nebraska, by the said Robert Beberniss and George Beberniss; and that there is'no inheritance
<br />tax due and payable from any of the other legatees and devisees in said will named; that no
<br />assets remain in the hands of the executor; that the estate should be closed, the executor die
<br />charged and his bond released.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Emil Hann.;
<br />executor of the last will and testament of John Beberniss, deceased, be and the same is hereby
<br />approved and allowed as his final report; that the estate is hereby closed and settled, the
<br />executor discharged and his bond released:
<br />IT IS FURTHER ORDERED, ADJUDG'-TD AND DECREED that all claims against said estate have been paid,
<br />including all special legacies, distributive shares, bequests, charges and that all conditions
<br />imposed upon - Robert Beberniss in Paragraph Sight of said will and upon George Beberniss in
<br />Paragraph Nine of said Will, have been met and performed; that the expanses of administration
<br />of this estate have been paid; and that the amount of money,to -wit: $14s24.4s, in the hands of
<br />the executor after the payment of all claims, expenses, special legacies and bequests and othez
<br />claime, has been distributed by the executor according to the terms of the last will and testa-
<br />ment of John Beberniss, deceased, as follows: Elmer Beberniss $2117.92; Dora Henn* $2117.92;
<br />Anna Mackan $2117.92; Cecilia Mackan $2117.93; Augusta Hann $ 2117.93; Amanda Hann $2117,93 and
<br />Emma Beberniss $2117.93.
<br />IT'IS THEREFORE FURTHER ORDERED, ADJUDGED AND DECREED that by the terms and provisions of said
<br />last will and testament the following named persons were entitled to special bequests in the
<br />following amounts: Dora Henne $25.00; Anna Mackan $25.00; Cecilia Mackan $25.00; Augusta Hann
<br />$25.00; Amanda Hann $2500.00; Alfred Buettner $633.33; Helen Buettner $633.33; sthel Buettner
<br />$633.34.
<br />That the executor has paid same and has vouchers therefore on file. -
<br />IT is FURTHER ORDERED, ADJUDGED AND DECREED that the said Robert Beberniss has performed each
<br />and every condition imposed upon him in Paragraph 8 of said will and that the following descril
