<br />(ESTATE OF JOHN BEBERNISS, FINAL DECREE.
<br />DECEASED.
<br />NO *n this 3rd day of October, 1925, this cause came on for hearing upon the final report of
<br />Emil Hann, executor of the last will and testament of John Beberniss, deceased, and upon his
<br />petition for settlement of said estate, and the court having examined the records and files,
<br />and being duly advised in the premises finds that due and legal notice has been given to all
<br />persons interested in said estate of the time and place fixed for hearing upon said report as
<br />heretofore ordered by the Court.
<br />And no one appearing to object to said report, and the court being duly advised.in the premise
<br />finds that said report is true and correct and that the same should be allowed and approved as
<br />and for the final report of the said executor.
<br />The court finds that the said John Beberniss departed this life testate, on the 21st day Of
<br />December, 1927, and that at the time of his death he was a resident and inhabitant of Hall
<br />County, Nebraska.
<br />That on or about the 3rd day of January, 1925, George Beberniss filed in this court his duly
<br />verified petition praying for the allowance and probation of an instrument purporting to be th
<br />last will and testament of John Beberniss,deeeased; that the court thereupon fixed the 31st da
<br />of January, 1925 as the date for making proof of said will and due notice of the filing of sai
<br />petition and the time and place fixed for hearing thereon was given by the court in the manner
<br />provided by law and that on the 31st day of January, 1925, said instrument was duly proven,
<br />allowed and admitted to probate as and for_the last will and testament of John Beberniss,
<br />deceased, and Letters Testamentary were duly issued to Emil Hann, the executor named in said
<br />will and he duly qualified as such.
<br />The Court further finds that said last will and testament had thereto attached two oodieils,
<br />which said codicils form a part of said will and are in all respects admitted an and for a
<br />part of the last will and testament of the said John Beberniss,deceased....
<br />The court further finds that due and legal notice has been given to all persons of the time
<br />place fixed by the court for the presentation of claims against said estate and that the time
<br />fixed has fully expired and that all persons having claims against said estate are forever
<br />barred and excluded from ever setting up or asserting such claims.
<br />The court further finds that at the time of the decease-of the said John Beberniss he was
<br />single and that his wife, Alvina Beberniss, had proceeded him in death.
<br />The court further finds that the said John Beberniss left as his heirs and only heirs at law
<br />the following named persons: Dora Hennes Anna Maokan, Amanda Hann, 0ecilia X&Okan, Augusta
<br />Hann, Emma Beberniss, Charles Bebernise, William Beberniss, George Beberniss, Robert Bebernis
<br />and Elmer Beberniss, and the following named grandchildren: Ethel Butettner, Helen Beier,
<br />and Alfred Buettner, Children of a deceased daughter Lena Buettner, and that all of the above
<br />named onildren except the grand children, are of legal age, and that the said grandchild
<br />Helen Beier is of legal age.
<br />The Court further finds by the terms and provisions of the last will and testament of the
<br />John Beberniss, deceased, all of the personal property after the payment of all debts,
<br />expenses, costs of this proceeding and .other just clatmg, passed and descended to the follows;
<br />named persons, to- wit: Elmer Beberniss, Dora Hennes Anna Maekan, Cecilia Maekant Augusta Hann
<br />Amanda Hann, and Emma Beberniss, share and share alike, and that the executor after the pay-
<br />ment of all just claims and expenses had on hand for - distribution to the above name persons
