....... _... --STa JO <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA. <br />:IN THE MATTER OF THE ESTATE ) <br />OF FINAL DECREE <br />AGNES GUTHRIE,DECEASED. <br />Now on this 29" day of January,1930,this cause came on for hearing upon the final report of tho <br />;;Nebraska Loan and Trust Company of Grand Island,Nebraska, administrator of the estate of Agnes;! <br />Guthrie,deeeased, and it appearing from the files in this office that notice was given to all <br />;;persons interested as to the filing of said report and to the time and place of hearing thereo�A' <br />,; <br />::by publication of such notice one week prior to the 29" day of January,1930,and that no -one <br />"appeared to object or protest against the allowance of said report. <br />On consideration of the tiles and the testimony, the court finds that the said administrator <br />:;has accounted for all property coming into its hands, and that its report is correct in all <br />"respects and ought.,to be allowed; that the administrator has received from all sources as such; <br />administrator the sum of $74.50 and has paid out said sum for attorney fees,court costs and <br />i <br />:costs of administration and that there remains nothing in the hands of the administrator for <br />distribution. <br />''It is,therefore,considered by the Court that the report of the Nebraska Loan and Trust Company <br />administrator, be and the same is hereby approved and allowed, as and for its final account, and <br />that upon its filing in this court the receipts of those entitled to share in the distribution; <br />it be discharged of its trust and its bond released. <br />The Court finds that notice was given to creditors of said deceased of the time allowed for <br />'.filing claims against said estate,by publication, as required by law and by order of Court, an <br />that the time allowed for filing claims has fully expired; that all claims filed and allowed <br />against said estate have been paid and that all claims outstanding against said deceased and <br />not so filed are forever barred and excluded. <br />It is therefore considered by the Court that all persons are forever barred from filing or <br />..setting up any claims or demands against the estate of Agnes Guthrie,deeeased. <br />,The Court finds that the said Agnes Guthrie died on the 2nd day of March,1928; that she was at' <br />the time of her death a resident of Newton,Jasper County,Iowa, and that she died intestate, <br />,leaving her as her heirs at law and her only heirs at law the following named persons: Steward <br />iI.Guthrie,a son, Vernon A.Guthrie,a son, and Frank A.Guthrie,a son. <br />'The Court finds that the said Agnes Guthrie died seized in fee of the undivided one -third <br />;interest in and to the following described real estate situate in the County of Hall. and State <br />':of Nebraska,to -wit: The Northwest Quarter (NWJ) of Section Thirty -six (36),Township Twelve (1� <br />,Range Twelve (12), Test of the 6th P.M. in Hall County,Nebraska,containing 160 aeres,more or 1� <br />The Court finds that under the law of descent of the State of Nebraska all of the right,title <br />and interest of the said Agnes Guthrie in and to the above described real estate did pass and <br />descend at her death in the manner following: To Stewart I.Guthrie,a son, 1/3 thereof; to <br />!Vernon A.Guthrie,a son 1/3 thereof; to Frank A.Guthrie,a son,1/3 thereof. <br />110..It is therefore considered,adjudged and decreed by the Court that all of the right ,title and <br />interest of Agnes Guthrie in and to an undivided one -third interest in and to the Northwest <br />ss . <br />Quarter (NWT}) of Section 36,Township 12,Range 12, West of the 6thP.M.in Hall County,Nebraska,d4d <br />;pass and descent at her death under the provision of the Law of Descent of real estate in the <br />';State of Nebraska,in the manner following: To Stewart I.Guthrie,Vernon A.Guthrie and Frank A. <br />��Guthrie in equal shares and it is so awarded. <br />Paul N.Kirk <br />Oounty;Judge. <br />
