<br />The Court further finds that the said Eberhart Kunz, deceased, died seized as the owner of the
<br />northwest quarter of the northeast quarter of Section 13, in Township 9 North, Range 12,West,
<br />in Hall County, Nebraska, and that under the terms and provisions of the last will and testame t
<br />of said Eberhart Kunz, deceased, the same passed, by absolute title, to. Charles W. Kunz, a son
<br />of said deceased.
<br />The Court further finds that the said Eberhart Kunz deceased, died seized as the owner by fee
<br />simple title of the southeast quarter of the northeast quarter and Lot 1 in Section 13, Townsh p
<br />9, North, Range 12, Pest, in Hall County, Nebraska, containing 64.50 acres, and that under the
<br />terms and provisions of the last will and testament of the said Eberhart Kuns,deceased, the sane
<br />passed, by absolute title, to Fannie P. Towne, a daughter of said deceased, who is described a
<br />Frances K.Towne in the last will and testament of said Eberhart Kunz, deceased, the said Fannie
<br />P. Towne and Frances K.Towne,being one and the same person, notwithstanding the discrepancy in
<br />names, and Fannie P.Towne being the correct name of said daughter and deviseeof said Eberhart
<br />Kunz, deceased, and he having no daughter by the name of Frances K.Towne. I�
<br />The Court further finds that the said Eberhart Kunz, deceased, died seized as the owner by feed
<br />simple title ofthe southwest quarter of the northeast quarter and Lot R in Section 13, in
<br />Township 9 North of Range 12 hest, in Hall County, Nebraska, containing 82.75 acres, a little !�
<br />more or less, and that under the terms and provisions of the last will and testament of the
<br />said Eberhart Kunz, deceased, the same passed and descended, by absolute title, as follows:
<br />An undivided one -sixth each to William E.Kunz, Edward Kunz, James G.Kunz, Charles W.Kunz, and �I
<br />Margaret Shoemaker, sons and daughter of said Eberhart Kunz, deceased, and an undivided one-
<br />. I
<br />twenty- fourth each to Avis Burmood Miller, 4ela Burmood Olson, Gaius Burmood, and Jay Burmood,
<br />grandchildren of said deceased.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREEED BY THE COURT that the final report of the sail
<br />James G.Kunz as executor of the last will and testament of the said Eberhart Kunz, deceased, b,,
<br />and the same hereby is, in all things, approved and allowed as and for the final report of sail
<br />executor, said estate is hereby settled and closed and said executor discharged.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims agains
<br />the estate of the said Eberhart Kunz,deceased, if any such there be, are forever barred, en-
<br />joined,and excluded from setting up or asserting any such claims against said estate.

<br />will and testament of the said Eberhart Kunz, deceased, the east 45 feet of Lot 8 and all of
<br />Lot 9 in Block 7 in the Original Town of Wood River, Hall County, Nebraska, passed, by absolutp.
<br />title, to Sarah Kunz, surviving widow of said deceased; that the northeast quarter of the nort -
<br />west quarter of section 18, in Township 9 Ncrth of Range 11 West, in Hall County, Nebraska, su
<br />ject, however, to a strip two rods in width off the east side thereof for a road to Lot 3, in
<br />said Section, passed and descended, by absolute title, to William E.Kunz, a son of said deceas ;
<br />that Lot 3 in said Section 18, in Township 9 North of Range 11 West, in Hall County, Nebraska,
<br />Passed by absolute title, to Edward Kunz, a son of said deceased; that the northwest quarter o
<br />the northwest quarter of said Section 18,in Township 9 North, Range 11 West, in Hall County,
<br />Nebraska, passed by absolute title, to Avis Burmood Miller, Lela Burmood Olson, Gaius Burmood,
<br />and Jay Burmood, grand children of said deceased, share and share alike; that Lot 5 in Section
<br />18 in Township 9 North of Range 11 West in Hall County,Nebraska, passed, by absolute title, to
<br />Margaret Shoemaker, a daughter of said deceased; that the southwest quarter of the southwest
<br />quarter of Section 7, in Township 9 North, Range 11 West,in Hall County,Nebraska, passed, by a
<br />absolute title, to James G.Kunz, a son of said deceased; that the northwest quarter of the nor h
<br />east quarter of Section 13,in Township 9 North, Range 12 Test, in Hall County, Nebraska, passe
