<br />"LAST WILL AND TESTAMENT OF
<br />EUGENE J . HAINER.
<br />KNOIT ALL MEN BY THESE PRESEN "rS: That I, Eugene J.Hainer,of the City of Lincoln,Lancaster
<br />County,Nebra.ska, being of lawful age, a widower, of sound and disposing mind and memory, do,
<br />for the purpose of disposing of all the property of which I :nay die seized, hereby make, or
<br />declare and publish tnis my
<br />LAST MILL AND TESTAMENT
<br />hereby revoking all former wills by me made.
<br />FIRST: I direct the payment of all just claims against my estate, recourse being first had foi
<br />that purpose to my personal estate.
<br />SECIND: I direct that a portion of my personal estate of the fair actual market value of Two
<br />Hundred Fifty Thousand dollars ($250,000.00) shall,with the approval of the Probate Court and
<br />the residuary legatees hereinafter named, be set aside as and in a trust fund, said trust to
<br />be administered by my son- in- law,Leonard E.Hurtz.
<br />The income from said trust or as much thereof as may be necessary shall be distributed in
<br />annuities as listed below. Any income remaining in said trust fund at the end of each year i
<br />excess of Ten Thousand Dollars ($10,000.00) after meeting the requirements of said trust,shal
<br />be distributed in equal amounts to my two daughters,Julia H. O'Connor and Laura H.Hurtz.
<br />In the event one or more of the beneficiaries of the said annuities predeceases me or as from
<br />time to time one or more of them die, and the income becomes greater than necessary to pay th
<br />remaining annuities the trustee may, with the approval of said Probate Court and the residua,
<br />legatees herein named, dispose of a portion of the trust fund leaving enough in the trust
<br />to produce sufficient income to pay the remaining annuities as the same mature.
<br />The Trustee is authorized in the interest of said estate, with the approval of the Probate
<br />Court and the residuary legatees herein named,to sell, transfer, convey or exchange the secur
<br />ties placed in the said trust fund, the income from such sales or transfers to be placed in toe
<br />fund or reinvested for the benefit of the fund.
<br />In the event the above named Trustee cannot serve, another Trustee shall be named by the
<br />residuary legatees of this will,Julia H.010onnor and Laura H.Hurtz.
<br />When all of the annuities listed herein have been paid the trust shall be deemed terminated
<br />and the remainder, if any of said trust funds shall be distributed in equal amounts to my
<br />daughters, Julia J.O'Connor and Laura H.Hurtz.

<br />The annuities to be paid from said trust shall be as follows:
<br />a. To my brother,Julius C.Hainer of St. Louis,Missouri, an annuity of Three Thousand Dollarsl�
<br />($3,000.00). Same to be paid to him in equal quarter yearly installments for and during the
<br />full period and term of his natural life, the first payment to be made at the expiration of
<br />three months after my death. If my brother Julius C.Hainer should die before his wife, Addie
<br />Rice Hainer, she shall be paid an annuity equal to one -half of the above sum as above provide
<br />for my said brother,Julius C.Hainer, payments to be made in quarter yearly installments, begi -
<br />ning three months after the death of her husband,Julius C.Hainer.
<br />b. To my brother, Bayard T.Hainer, of Oklahoma City, Oklahoma, an annuity of Three Thousand
<br />Dollars ($3,000.00). Same to be paid to him in equal quarter yearly installments for and dur rag
<br />the full period and term of his natural life, the first payment to be made at the expiration
