MAI <br />same,became and was and is the homestead of Eleanor C.Hulme,the surviving widow of said Th <br />Hulme,deceased,and since the death of the said Thomas Hulme the said Eleanor C.Hulme,surviv <br />widow cffsaid deceased,has been entitled to all of the income from said homestead estate,and <br />is now entitled to the same. <br />The Court further finds that the said Thomas Hulme left surviving him,as his heirs at lair, <br />and his only heirs at law,said Eleanor C.Hulme,his surviving widow and mother of all his <br />i <br />children,and George P.Hulme,Anna A.Hulme,Eleanor M.Hulme,Thomas H.Hulme,and Francis E.Hulme," <br />sons anddaughters of said deceased,allof whom are still living and are of lawful age. <br />The Court further finds that since the death of the said Thomas Hulme,Thomas H.Hulme,as <br />administrator of the estate of said deoeased,has collected the rents,issues,and profits arising <br />from the real estate hereinbefore described under the mistaken assumption that the rents,issules, <br />and profits arising fromsaid real estate belonging to the estate of said deoeased,when in <br />truth and in fact all of the rents,income,and profits from said real estate,after the death <br />of the said Thomas Hulme,belonged to and were the absolute property of Eleanor C.Hulme,the <br />surviving widow of said deceased,in her capacity as the owner of the homestead estate inlaid <br />real estate,and all of the same,and that the said Thomas H.Hulme now has on hand,from the <br />rents,issues,and profits collected from said real estate,the sum of $4033.70,together with in- <br />terest thereon amounting to :1043.50,making the total amount due from the said Thomas H. <br />$5076.20,allof which belongs-.to the said Eleanor C.Hulme,surviving widow of said Thomas <br />Hulme, deceased, as the owner of a homestead estate in all of the real estate hereinbefore de <br />cribed,and that said Thomas H.Hulme should pay said sum to the said Eleanor C.Hulme as her <br />absolute property. <br />The Court further finds that the said Thomas H.Hulme,administrator,has paid the funeral <br />expenses ofsaid deceased, the costs of this proceeding,and the debts against said estate <br />and nothing farther remains in his possession belonging to said estate;that said estate is <br />not subject to an inheritance tax under the laws of the state of Nebraska nor to a Federal <br />estate tax under the laws of the United States;and that said estate ought to be settled and <br />closed and said Administrator discharged. <br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of said <br />Thomas H.Hulme,Administrator of the estate of the said Thomas Hulme,deceased,be,and the same <br />hereby is,allowed and approvedas and for his final report,as such administrator,and said <br />administrator is hereby directed to pay over to Thomas Huxlme,as guardian for Eleanor C.Hulme, <br />incompetent,the said sum of $5076.20,so remaining in his hands,and upon filing inthis Court <br />a receipt showing thepayment of said sum to the said Thomas H.Hulme,as guardian,that said <br />administrator be discharged,and said estate settled and closed. <br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims <br />against the estate of the said Thomas Hulme,deceased,if any such there be,are forever barred, <br />enjoined,and excluded from setting up or asserting any such claims against said estate. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that upon the death of the said <br />Thomas Hulme,Eleanor C.Huime,his surviving widow,became the owner of a homestead estate in <br />and to all of the real estate hereinbefore described, and that under the intestate laws of <br />the state of Nebraska in force at the time of the death of the said Thomas Hulme,said real <br />estate,passed,subject to the homestead estate of the said Eleanor C.Hulme,as follows; An un- <br />divided one -third thereof to said Eleanor C.Hulme,surviving widow of said deoeased,and un <br />undivided two- thirds thereof,in equal shares,to George P.Hulme,Anna A.Hulme,Eleanor -4.
