<br />Henry A. Koenig, Deceased. )
<br />On this 9th day of July, A. D. ,1929, this cause came on for hearing upon thefinal report of
<br />69 s
<br />Agatha M. H. Koenig, executrix of the last will andtestament of Henry A.Koenig, deceased, and it
<br />appearing to the satisfaction of the court from theproof now on file, that notice of the fil-
<br />ing of said report, and of the time fixed for final settlement of said estate has been given
<br />to all persons interested therein by publication of such notice in the Grand Island Daily
<br />j Independent, and that no -one has appeared to object to or protest against the allowance of
<br />i
<br />said report.
<br />On examination thereof, the court finds that said Agatha M. H. Koenig, executrix, has accounted
<br />for all of the estate coming into her hands or under her control, has paid the expenses of
<br />administration, and has turned over to herself as legatee, the balance of the personal proper -
<br />ty received by her after her appointmebt, consisting of 40 shares of stock. in the Equitable
<br />Building & Loan Association, of Grand Island, Nebraska, and the sum of $93.00 in cash; that
<br />her report is correct in all respects, and ought to be approved and allowed.
<br />The court finds that by order of court, dated June 30, 1905, creditors of said decedent were
<br />allowed six months from the 13th day of July, 1905, in which to file their claims, duly
<br />authenticated, in the office of the County Judge of Hall County, Nebraska, for audit and
<br />allowance; that notice of the time allowed and place appointed for filing claims against said
<br />estate was published for four consecutive weeks in The Free Press, a weekly newspaper, public
<br />ed and circulating in Hall County,Nebraska; that the time so allowed for filing claims has lon
<br />since expired; that no claims of any nature were filed or allowed against said estate; that
<br />all claims outstanding against said estate, if any such there be, are forever barred and
<br />excluded.
<br />IT IS THEREFORE CONSIDERED by the court that the report of the executrix of the estate of
<br />Henry A.Koenig, deceased, be and the same is hereby allowed as and for her final account.
<br />IT IS FURTHER CONSIDERED that all persons are forever barred from filing or setting up any
<br />claims or demands against the estate of Henry A.Koenig, deceased.
<br />The court finds that the said Henry A.Koenig departed this life on the 19th day of Apri1,A. D. ,
<br />1905, leaving a last will and testament, which instrument was duly proved, allowed and admitt
<br />to probate in the County Court of Hall County, Nebraska, on the 30th day of June, A.D.,1905, i

<br />and entered of record in this office. f

<br />The court finds that the said Henry A.Koenig left surviving him as his heirs -at -law, and his
<br />only heirs -at -law, the following named persons, to -wit: Agatha M. H. Koenig, his widow, and
<br />Richard W. Koenig, his son, Mary C. Janss, his daughter, and Arnold C. Koenig, his son.
<br />The court further finds that the said Henry A.Koenig died seized in fee of the following des-
<br />cribed real estate, situated in the County of Hall and State of Nebraska, to -wit:
<br />Lots six (6) and seven (7) in Block twenty -four (24), inBaker's Addition to the City of Grand
<br />Island, Hall County, Nebraska, and that under the terms and provisions of said last will and
<br />testament, said real estate, as well as the personal property hereinbefore mentioned, did pas
<br />and descend at the death of said Henry A. Koenig, to his widow, Agatha M. H. Koenig, for her Sol
<br />use and benefit during, her natural life, with full power to sell and convey, to mortgage or
<br />lease said real estate. If said property be undisposed of in the lifetime of the said Agatha
<br />M. H. Koenig, the same passes and descends at her death, under and by virtue of the provisions
<br />of his last will and testament, fro the said children of the said Henry A.Koenig, deceased, narr
<br />Richard W. Koenig, Mary C. Janss, and Arnold C. Koenig, in absolute title, and in equal shares,
