<br />Weaver departed this life intestate.
<br />12. That on the 4th day of March,1921,by an order duly entered all the household goods,

<br />wearing apparel,ornaments and personal effects of said William Weaver,deceased and the sum
<br />of $200.00 were assigned and set over to Rosalia Weaver,widow,as by law provided,and that
<br />a further sum of $200.00 per month from the 21st day of August 1920 to the 21st day of
<br />August,lKt,was assigned to the said Rosalia Weaver,widow,as her allowance during adminis-
<br />tration of said estate as by law provided.

<br />This agreement made and entered into this fourth day of May,A.D.1921,by and between Rosa-
<br />�jlia Weaver,widow of said William Weaver,Deceased,party of the first part,and Amasa Weaver,
<br />j, William Weaver,Julia Artz,Rose Gilmore,Emma Mott and Ethel Ramsey,childrenof William Weaver,
<br />deceased,and Walter Prall,Raymond Prall,Viola Stiner,Susie Grover,and Lottie Reed Nock,
<br />children of Lizzie Reed ,a deceased daughter ofsaid William Weaver

<br />�I WITNESSETH :Whereas,no provision is made in the last will and testament of said William
<br />Weaver,deceased for the appointment of a trustee for the management and control of the pro-
<br />perty belonging to said estate during the life time of Rosalia Weaver,party of the first

<br />t� part , and
<br />WHEREAS,no provisions is made in said last will and testament as to the amount to be
<br />expended for a monument to be erected as the grave of said William Weaver,deceased,and said

<br />l Rosalia Weaver,and,
<br />WHEREAS,the parties hereto desire to make suitable provisions for both,and in considers
<br />tion of the mutual promises and benefits derived therefrom,
<br />hNOW THEREFORE,It is stipulated and agreed,

<br />FIRST.
<br />That the answer of the administrator filed to the petition of said Rosalie Weaver for
<br />the allowance of the sum of Fourteen Hundred and Fifty ($1450.00) Dollars,for the purchase
<br />of a monument shall be withdrawn,and the prayer of said petition shall be granted,and the
<br />1 administrator with will annexed,authorized to pay for said monument out of any funds in his
<br />hands belonging to said estate.
<br />SECOND.

<br />That Charles K.Hart,administrator of said estate with will annexed,shall act as trustee
<br />for all of the property belonging to said estate during the lifetime of said Rosalia Weaver,
<br />and shall have the exclusive management of all of said property,collecting the rents,interest
<br />and income thereof,and paying the taxes expenses and all allowances made by the County Court,
<br />and such distribution of the net proceeds as is provided in the will and may be ordered by
<br />said court.
<br />THIRD.
<br />That the said Rosalie Weaver does hereby renounce her right to have the management of said
<br />estate,and does hereby designate and appoint the said Charles K.Hart,administrator,of said
<br />estate with will annexed,to have the exclusive management and control of all the property
<br />� belonging to said estate.
