<br />At a Session of the County Court held in and for said County,at the County Court Room,
<br />in the City of Hastings,County of Adams and State of Nebraska.
<br />Present:Joseph H.Turbyfill,Judge of the County Court.

<br />DECREE OF FINAL ACCOUNT
<br />AND
<br />DISTRIBUTION OF ESTATE.

<br />Now on this the 16th day of May,1921,this cause came on for hearing upon the report and
<br />petition of Charles K.Hart,Administrator C.T.A.of the estate of William Weaver deceased,for
<br />final settlement and distribution,and for his discharge as such Administrator and the evid-
<br />ence and was submitted to the Court.
<br />ON CONSIDERATION WHEREOF,the Court finds from the proofs on file,and records and the
<br />evidence.
<br />1. That due and legal notice of this hearing was had by publication according to law said
<br />cause having been left open from the 14th day of May,1921,until this time.
<br />2. That said William Weaver,departed this life at the Nebraska Sanitarium,in the City of
<br />Hastings in said County on the 21st day of August,1920,and was at the time of his death
<br />a resident ofand domiciled in the City of Hastings,County of Adams and State of Nebraska.
<br />3. That on the 23rd day of September,1920,a paperwriting purporting to be the last Will
<br />and Testament of said William Weaver,deoeased,together with a petition praying for the pro-
<br />bate of the same was duly filed in this Court.
<br />4. That on the 18th day of October,1920,after notice thereof had been duly given accord -
<br />ing to law said Will ivas by this Court duly admitted to probate and a decree was duly
<br />entered proving,approving,probating and allowing said instrument as the Last Will and Testa-
<br />ment of said William Weaver,deceased,and directing that Letters of Administration,with Will
<br />Annexed issue to Charles K.Hart upon his taking and filing oath as required by law and filing
<br />bond in the sum of $40,000.00 with sureties to be approved by this Court.
<br />Said will together with the Certificate of probate thereof being in words and figures
<br />following,to—wit:-
<br />LAST WILL AND TESTAMENT OF WILLIAM °'WEAVER.
<br />I,William Weaver,of Prosser,Adams County,Nebraska,of lawful age,and being of sound mind
<br />and memory,do hereby make,publish and declare this instrument to be my Last Will and Tests-
<br />ment wherein I have disposed of all my real,personal,and mixed estate in the manner and form
<br />hereinafter set forth.

<br />I direct the speedy payment of all my just debts including the expense of my last sickness
<br />and funeral charges,and of the probate of this my Last Will and Testament,and the costs and
<br />charges of the administration of my estate;and that the same be paid out of my personal pro-
<br />pert y.

<br />I do hereby will,devise and bequeath to my wife,Rosalie Weaver,in lieu of the provisions
<br />of the statute,all of my estate,both personal and real,for her use and benefit during her
<br />lifetime;and she shall not have the power to tra.nsfer,encumber or convey any real estate;
<br />that she shall pay all taxes and assessments levied against the same out of the income
<br />therefrom;and shall pay to my ExecutorJor their successors,on demand,a sufficient sum in
