L L KM M <br />63 <br />upon her petition,for the allowance and approval of said report,the settlement of said <br />estate,and her discharge herein,and the Court,having examined the records and files herein, <br />and being fully advised in the premises,finds thatdue and legal notice has been given to all <br />persons of the time and place fixed by the Court for the hearing upon aLid final report,and <br />no one appearing to object to said report,and the Court,having examined the same,together <br />with the vouchers on file,finds that said report is true and correct in all things and that <br />the same ought to be.approved and allowed as and for the final report of said Administratrix, <br />said estate settled and closed and said Administratrix discharged. <br />The Court further finds that the said Peter Wiese departed this life on the 17th day of <br />December,1928,and at-the time of his death he was a resident and inhabitant of Hall County, <br />Nebraska,and left a last will and testament which w as,by the consideration of this Court, <br />duly proven,allowed and admitted to probate on the 22d day of January,1929;that the said <br />Teter Wiese was a widower at the time of his death,Mena Wiese,the wife of the said Peter <br />'Wiese and the executrix named in his said last will aid testament,having preceded him <br />in death,and that letters of administration with the will annexed were duly issued by this <br />Court to Adele Wicker,m d she duly qualified as Administratrix with the will annexed of <br />the estate of the said Peter Wiese,deceased. <br />The Court further finds that due and legal notice has been given to all persons of the <br />time and place fixed by the Court for filing claims against the estate of said deceased, <br />and that the time so fixed has fully expired,and that all persons having claims against said <br />estate,and not filed within the time limited by the Court,are forever barred and excluded <br />from setting up or asserting any such claims against said estate. <br />The Court further finds that said AdministTatrix has paid the funeral expenses of said <br />deeeased,all debts against said estate,and the costs of this proceeding,a.nd has made due <br />distribution of the residue of the personal estate of said deceased to the legatees under <br />the will of said deceased,and nothing further remains in the hands of said Administratrix <br />belonging to said estate. <br />The Court further finds that the estate of said deceased is not subject to an inheritance <br />tax under the laws of the state of Nebraska,nor to a Federal estate tax under the laws of <br />the United States. <br />The Court further finds that said Peter Wiese died seized as the owner,by fee simple titlef <br />of Lots One (1) and Two (2),the southeast quarter of the northwest quarter,and the northwest <br />quarter of the northwest quarter,of Section Two (2),in Township Ten (10) North,Range Nine, <br />West,and a strip of ground in the same section,deseribed as follows:Commencing at the north - <br />east corner of the southwest quarter of the northwest quarter of said Section Two (2),in <br />Township Ten (10) North of Range Nine (9) West of the 6th P.M.,and running thence west <br />on the north line of said southwest quarter of the northwest quarter 16 feet;thence in a <br />southeasterly direction to the southeast corner of said southwest quarter of the northwest <br />quarter;thence north to the place of beginning,excepting the south S feet of the northeast <br />quarter of the northeast quarter of said Section 2 deeded to.Fred Falldorf by deed recorded <br />in Book 22 of deeds at page 474,and excepting the south 8 feet of the west 79 rods of the <br />northwest quarter of the northwest quarter of said Section 2,deeded to John Falldorf by deed <br />recorded in Book 55 of deeds at page l,all of the deed records of Hall County,Nebraska; <br />Also Lots One (1) and Five (5) in Block Four (4) in South Grand Island,an Addition to <br />the city of Grand Island,in Hall County,Nebraska,as surveyed,platted,and recorded. <br />The Court further finds that under the terms and provisions of the last will and testa- <br />ment of said Peter Wiese,deceased,and by reason of the fact that the said Mena Wiese,wife <br />
