N69.. <br />f <br />undivided one -third interest in and to the West Half of Lot ll,above desoribed,and is a <br />competent and proper person to.institute and poosecute this proceeding. <br />The court further finds that the said Elizabeth E.Fisher left surviving her,her husband, <br />Elijah J.Fisher,and May T.Fisher West,a_daughter,both of whom are of legal age;that upon the <br />is i <br />death of thesaid Elizabeth Z.Fisher,under the laws of the State of Nebraska,then in force, <br />the real estate hereinbefore desoribed,to -wit; Lot 11 in Block "D" in the First Addition to <br />the village of Wood River in Ha110ounty,Nebraska,passed and descended in equal shares to El- <br />ijah J.Fisher and May T.Fisher West,one- half to eaeh,as tenants in common. <br />The court further finds that the said Elizabeth E.Fisher left a personal estate sufficient <br />to pay her funeral expenses and debts,and that such funeral expenses and debts have been <br />fully paid ;that if any debts existed against said estate of the said Elisabeth E.Fisher,deee <br />such debts are long since barred by the Statute of Limitations and are now forever barred an <br />preoluded,and the Court finds that the costs of this proceeding have been paid in full by th <br />petitioner herein,JohnE.Rounds. <br />The Court further finds that at the death of the said Elisabeth E.Fisher,said real estate <br />heretofore desoribed,was of the value of Five Hundred Dollars and that it is now of the value <br />of Five Hundred Dollars. <br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the said Elizabeth E.Fishes <br />died intestate in the city of Pasadena,State of California;that she died on the 21st day of <br />April,1887,and at the time of her death she was a resident and inhabitant of the City of <br />Pasadena,State of California,and that more than forty years have *lapsed since the death <br />of the said Elizabeth E.Fisher;that no administration has ever been had or applied for upon <br />the estate of the said Elisabeth E.Fisher,deceased,in the State of Nebraska;that the said <br />Elisabeth E.Fisher died seised as the owner in fee simple;,title of Lot Eleven (11) in Block <br />"D" in the First Addition to the village of Wood River in Hall County,Nebraska•,that she left <br />surviving her Elijah J.Fisher,her husband,and.May T.Fisher West,her daughter,both of whom <br />are of legal age,as her heirs at law and her only heirs at law;that under the laws of descent <br />r; of the State of Nebraska in force at the time of the death of the said Elisabeth E.Fisher, <br />the said Elijah J.Fisher,surviving husband,and May T.Fisher West,surviving daughter,beoame <br />k' <br />the owners of the real estate hereinbefore described and that the same passed and descended, <br />upon the death of the said Elizabeth E. Fisher,in equal shares to the said Elijah J. Fisher and <br />May T.Fisher West,and to their respective heirs and assigns forever,and that the same is here <br />so awarded,and that all debts of said deeeased,if anyi such existed,are forever barred and <br />preeluded,and further administration of the estate of Elisabeth E.Fisher,deoeased,is hereby <br />dispensed with,and said estate is forever closed and settled. <br />It is further ordered,adjudged and decreed by the Court that John E.Rounds,petitioner here <br />has paid the court costs and expenses of administration of said estate herein in full;that <br />he has waived any claim for the court costs and expense of administration against the Westerl <br />One -Half of Lot ll,above deseribed,but thht said John E.Rounds,petitioner herein,has a claim <br />and lien upon the Easterly One -Half of Lot ll,above described,for the sum of $30.00 being one. <br />half of the amount expended by the said John E.Rounds in the payment of court costs and costs <br />of administration and attorney fees herein,and that the said John E.Rounds,petitioner herein <br />!` is hereby given and granted a lien upon the Easterly One --Half of Lot ll,above desoribed,for <br />the said sum of $30.00,and that upon the payment of said sum by the owners or owner of the <br />Easterly One -Half of Lot ll,above described,to the said John E.Rounds the said lien shall be <br />released and discharged of record. <br />Dated this 3 day of June,A.D.1929.
