<br />ghat at the time of her death she was the owner of an undivided one -half interest in and to
<br />the following described premises,to -wit:
<br />Lot Seven (7) in Block Thirty -eight (38) in Russel Wheeler's Addition to the City of
<br />Grand Island,Nebraska
<br />that more than two years have elapsed since her death and that no application has been made
<br />in the State of Nebraska for the appointment of an administrator of said estate and no ad-
<br />ministration has been had of said estate.
<br />The Court finds that said deceased left surviving her the following and only heirs -at -law,
<br />to -wit: Elsner E.Huyck,husband,Orland T.Huyuk,son,Laura H.Johnson,daughter and Beatrice Mellin,
<br />a daughter.
<br />That the said Lizzie M.Huyck died seized of an undivided one half interest in and to the
<br />following described real estate,to -wit: Lot 7 in Block 39 in Russell Wheeler's Addition to
<br />the City of Grand Island,Hall County,Nebraska,which said undivided one half interest in and
<br />to said real estate did pass and descend,on the date of the death of the said Lizzie M.Huy-
<br />ck,by operation of law,to the following named heirs at law as follows:
<br />To Elmer E.Huyck,an undivided j interest therein and to Orland T.Huyck,Laura H.Johnson and
<br />Beatrice Mellin,each an undivided 219 interest therein,subject to the homestead estate there
<br />which passed and descended by operation of law to Elmer E.Huyok,surviving husband of said
<br />deceased.
<br />The Court further finds that no petition or application has been filed in the State of
<br />Nebraska for the appointment of an administrator of the estate of said deceased and that no
<br />administration has been had upon her estate in the State of Nebraska,and that more than two
<br />years have elapsed since her death,that she died intestate,tha.t her funeral expenses have
<br />been paid,and that all the debts of said deceased,and her estate,have been paid and are
<br />forever barred and precluded,and that the costs of this proceeding haste been paid.
<br />The Court further finds that the petitioner,Orland T.Huyck,is the owner by fee simple titl
<br />of an undivided 2/9 interest in the real estate hereinbefore described,and is duly authorized
<br />by law to make this application in this Court.
<br />IT IS,THEREFORE,BY THE COLR T AJUDGED,CONSIDERED AND DECREED that said Lizzie - Huyck
<br />died intestate more than two years prior to the filing of the petition herein;that no app-
<br />lication for the appointment of an administrator of her estate has been made in the State
<br />of Nebraska,o r elsewhere,nor has there been any administration of her estate in the State of
<br />Nebraska,or elsewhere,and that she died seized in fee simple of an undivided � interest in
<br />and to the following; described real estate,to -wit: Lot 7 in Block 38 in Russell Wheeler's
<br />Addition to the City of Grand Island,Hall County,Nebraska;that she left surviving her as her
<br />sole and only heirs- at- law,the following named :Elmer E.Huyck,her husband,Orland T.Huyck,
<br />a son,Laura H.Johnson ",daughter,and Beatrice Mellin,a daughter;that the above described un-
<br />divided � interest in and to said real estate passed and descended upon the death of the said
<br />Lizzie M.Huyck,by operation of law,to Elmer E.Huyck,husband,an undivided one -third interest,
<br />to Orland T.Huypk,Laura H.Johnson and Beatrice Mellin each an undivided 2 /9interest therein,
<br />subject,however,to the homestead estate therein which passed and descended by operation of
<br />law to Elmer E.Huyek,surviving husband of said deceased,and the same is hereby awarded to the]
<br />as provided by the laws of descent of the State of Nebraska,and all debts of said estate not
<br />paid are forever barred and precluded,and that further administration of his estate is hereby
<br />dispensed with,said estate is hereby settled and forever closed.
