<br />Now on this 30 day of April 1929,this cause carne on for hearing upon the petition of
<br />Margaret Potter,heretofore filed herein praying for a settlement of the estate of said de-
<br />ceased,a determination of the heirs of said deceased,and degrees of kinship and the right
<br />of descent of his real estate,said petitioner being represented by Horth,Cleary & Suhr,her
<br />attorneys,and it appearing from the proof on file that due and legal notice of publication
<br />in "The Grand Island Independent ".a.legal newspaper printed in Hall County,Nebra,ska,for three
<br />successive weeks as 'by law provided and the order of this Court required,has been given to
<br />all creditors,heirs -at -law and persons interested in said estate,of the filing of said peti-
<br />tion and the time and place for hearing thereof,which time rotas more than 30 days and less
<br />than 60 days after the filing of said petition,a.nd there being no objections thereto,said
<br />cause was duly submitted to the Court on said petition and the evidence of the petitioner
<br />in support thereof,and the court being duly advised in the premises,finds that the allega.tior,
<br />in said petition are true,that the said Peter A.01Malley died intestate in Jefferson County,
<br />Washington,on the 24th day of October,1918,and at the time of hisdeath he was a resident
<br />and inhabitant of said Jefferson County,Washington;that more than two years have elapsed sinc
<br />his death and no application ha,s been filed in the State of Nebraska or elsewhere for the
<br />appointment of an adn inistrator of his estate,nor petition filed therefor and that no ad-
<br />ministration has been had upon his estate at any place.
<br />The Court finds that the said deceased left surviving him as his sole and only heir -a.t-
<br />law,his mother,Ma.ry O'Malley,of legal age.
<br />That said deceased died seized as the owner of an estate of inheritance in and to the
<br />following described premises situated in Hall County,Nebraska,to -wit;
<br />An undivided 1/15 interest in and to the West Half of the Northeast Quarter of Section 31,1
<br />Township 11,Range 10,West of the 6th P.M.in Hall Count y,Nebraska,subject to the life estate o)
<br />the above mentioned Mary 01 :14alley,his mother,in and to the above premises.
<br />!' That said real estate did,on the death of the said Peter A.011falley,pa.ss and descend by
<br />operation of law,under the law of descent in force in the State of Nebraska,tD the said 2Aary
<br />O'Malley,mot�er and sole heir ofsa:id deceased.
<br />The Court further finds that more than two years have elapsed since the death of the said
<br />decea,sed;tha,t he died intestate,that his funeral expenses and all other debts have been fully
<br />paid and that all other debts have been fully paid and that all claims or debts of the said
<br />estate and of said decea.sed,if any exist,are forever barred and precluded and the costs of
<br />these proceedings have been paid by the petitioner.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the said Peter A.OMalley died intestate,
<br />as above stated,.nore than two years prior to tine filing of thepetition in this cause;t#at
<br />no a.py ;lication for the appointment of an Administrator of his estate has ever been made,nor
<br />ah any administration upon his estate been had in the State of Nebraska,or at any other plat
<br />i, that he died seized as the owner of an estate of inheritance in the real estate above des-
<br />cribed situated in Hall County,Nebraska,and that upon his death the same passed and descended
<br />by operation,by operation of law,to his mother,Mary O'Malley,she being his sole and only
<br />heir -at -law and said estate is so awarded to her;..t.nat said deceased left surviving him as
<br />his only heir- at- law,his said mother,Ma.ry O'Malley,who bore the relation to him as above
