<br />Now on this 30 day of April 1929,this cause came on for hearing upon the petition of Mar-
<br />garet Potter,heretofore filed herein praying for a settlement of the estate of said deceased;
<br />a determination of the heirs of said deceased, and degrees of kinship and the right of des-
<br />f
<br />cent of his real estate,said petitioner being represented by Horth,Cleary & Suhr,her attorney 3,
<br />and it appearing fronthe proof on file that due and legal notice of publication in "The
<br />Grand Island Independent" a .legal newspaper printed in Hall County,Nebraska,for three success ve
<br />weeks as 'by law provided and the order of this Court required,ha.s been given to all creditors,
<br />heirs -at -law and persons interested in said estate,of the filing of said petition and the
<br />time and place for hearing t.ftereof,which time was more than 30 days and less than 60 days aft r
<br />the filing ofsaid petition,a.nd there being no objections thereto,said cause was duly submitte
<br />to the court onsaid petition and the evidence of the petitioner in support thereof,nnd the
<br />court being:; duly advised in the premises,finds that the allegations in said petition are true
<br />that the said William A.0'Malley died intestate in Hall County,Nebraska,on the 16th day of
<br />January,1916,a.nd at the time of his death he was a resident and an inhabitant of said Hall
<br />County,Nebraska;that more than two years have elapsed since his death and no application has
<br />been filed in the State of Nebraska or elsewhere for the appointrnentof an administrator of
<br />his estate,nor petition filed therefor and that no administration has been had upon his es-
<br />tate at any place.
<br />The Court finds that the said deceased,left surviving him as his sole and only heir -at -1
<br />his mother,nary O'Malley of legal age.
