<br />IN THE COUNTY COURT OF HALL COUNTY NEBRASKA
<br />IN THE MATTER OF THE ESTATE
<br />OF C DECREE
<br />Thomas O'Malley,Deceased
<br />Now on this 30 day of April 1929,this cause carne on for hearing upon the petition of
<br />Margaret Potter,heretofore filed herein praying for a settlement of the estate of said de-
<br />ceased,a determination of the heirs of said deceased,and degrees of kinship and the right
<br />of descent of his real estate,said petitioner being represented by Horth,Cleary & Suhr,her
<br />attorneys,and it appearing from the proof on file that due and legal notice of publication
<br />in "The Grand Island Independent" a legal newspaper printed in Hall County,Nebra.ska,for
<br />three successive weeks as by law and the order of tiais Court required,has been given to all
<br />creditors,heirs -at -law and persons interested in said estate,of the filing of said petition
<br />and the time and place for nearing thereof,which time was more than 30 days and less than
<br />60 days after the filing of said petition,and there being no objections thereto,said cause
<br />was duly submitted to the Court on said petition and the evidence of the petitioner in
<br />support thereof,and the Court being duly advised in the premises,finds that the allegations
<br />in said petition are true,that the said Thomas O'Malley died intestate in Hall County,Neb-
<br />raska,on the 11th clay of May,1914,and at the time of his death he was a resident and an
<br />inhabitant of said Hall County,Nebraska;that more than two years have elapsed since his
<br />death and no application has been filed in the state of Nebraska or elsewhere.-for the
<br />appointment of an administrator of his estate,nor petition filed therefor and that no ad-
<br />ministration has been had upon his estate at any place.
<br />The Court finds that the said deceased left surviving him as his sole and only heir -at-
<br />law,his mother,Mary O'Malley,of legal age.
<br />That said deceased died seized as the owner of an estate of inheritance in and to the
<br />following described premises situated in Hall County,Nebra.ska,to -wit;
<br />An undivided 1/15 interest in and to the "Vest Half of the Northeast Quarter of Section
<br />31,Township 11,North,Ra,nge 10,West of the 6th P.M.in Hall County,Nebra.ska, subject to the
<br />life estate of the above mentioned Mazy O'Malley,his mothefin and to the above prern;ses.. .
<br />That said real estate,did on the death of the said Thomas O'Malley,pass and descend by
<br />operation of law,under the law of descent in force in the State of Nebra.ska,to the said
<br />Mary O'Malley,mother and stile heir of said deceased.
<br />The Court further finds that more titan two years have elapsed since the death of the said
<br />I
<br />deceased,that he died intestate,that his funeral expenses and all other debts have been
<br />fully paid and that all other debts have been fully paid and that all claims or debts of
<br />the said estate and of the said deceased,if any exist,are forever barred and precluded and
<br />the costs of these proceedings have been paid by the petitioner.

<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the said Thomas O'Malley died intent -
<br />ate,as above stated,more than two years prior to the filing of the petition in this cause;
<br />that no application for the appointment of an Administrator of his estate has ever been made,'
<br />nor has any administration upon his estate been had in the State of Nebraska,,or at any
<br />Ether place;that he died seized as the owner of an estate of inheritance in the real estate �
<br />above described situated in Hall County,Nebraska,and that upon his death the same passed
<br />and descended,by operation of law,to his mother,Mary O'Malley,she being his sole and only
<br />heir- at -la,w and said estate is so awarded to her;that said deceased left surviving him as
<br />his only heir- at- Iaw,his said mohher,Mary O'�Malley,who bore the relation to him as above
