645 <br />the owners of an estate of inheritance in the real estate hereinbefore described,and were <br />competent and proper persons to prosecute this proceeding;that the funeral expenses of said <br />deceased and the debts of said deceased,and the costs of this proceeding,have been fully <br />paid,and if any debts exist against the estate of said deceased;the same have long since <br />been barred by the statutes of limitation of the state of Nebraska in such cases made and <br />provided;that the estate of said deceased is not subject to an inheritance tax under the <br />laws of the state of Nebraska,nor is it subject to a Federal estate tax under the laws of <br />the United States,and that the petitioners are entitled to a decree and order of the court <br />as in their petition prayed. <br />IT IS,THEREFORE,ORDERE?,ADJUDGED AND DECREED BY THE COURT that said Frances E.Kirkpatriek <br />departed this life,intestate,in Hall County,Nebra.ska,on the first day of March,1906,atidat <br />the time of her death the said Frances E.Kirkpatrick was a resident and inhabitant of Hall <br />County,in the state of Nebraska;that more than two years have elapsed between the date of <br />the death of said Frances E.Kirkpatrick and the filing of the petition herein;that no applica• <br />tion or petition has ever been filed for administration upon the estate of said deceased in <br />the state of Nebra.ska,nor has the estate of said deceased ever been administered upon;that <br />said Frances E.Kirkpatrick was a widow at the time of her death,and that she left surviving <br />her,as her heat a t'law,and her sole andonly heir, at law,Kate Darr,a daughter of said d e- <br />ceased;that said Frances E.Kirkpatrick died seized as the owner,by fee simple title absolute <br />of the undivided one —half of the north half of the southeast quarter,and the south half of <br />the northeast quarter of said Section 18,in Township 12 North of Range 11 West,in Hall <br />County,Nebraska,and that upon her death said real estate passed and descended,und er the <br />intestate laws of the state of Nebraskain force at the time of the death of said Frances <br />E.Kirkpatrick,to said Kate Darr,her daughter,by absolute title;that the petitioners at the <br />time of filing the petition herein were competent and proper parties to prosecute this pro - <br />ceeding for the purpose of determining the time and place of the death of said deceased, <br />that she died intestate,for a determination of who were her heirs at law,their degree of <br />kinship to her,and the right of descent of the real estate owned by said deceased at the <br />time of her death,and for the barring of claims against said estate,and that said estate is <br />not subject to an inheritance tax under the laws of the state of Nebraska,not to a Federal <br />estate tax under the laws of the United States. <br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all debts of the said Fran- <br />ces E.Kirkpatrick,if any such exist,are forever barred and precluded,and that further ad- <br />ministration of the estate of the said Frances E.Kirkpatrick,deceased,is hereby dispensed <br />with,and the estate of the said Frances E.Kirkpatrick,deceased,is hereby forever settled <br />i <br />and closed. <br />Pau 1 N.
