<br />Now,on this 20th day of April,1929,this cause came on for hearing upon the petition of
<br />Carrie Watkins,the present owner of the fee simple title to the north half of the southeast
<br />quarter and the southwest quarter of the northeast quarter of Section 19,and of Adolph Runge,;
<br />the present owner of the fee simple title to the southeast quarter of the northeast quarter
<br />ofsaid Section 18,all of said real estate being in Township 12 North ,Range 11 West of the
<br />6th P.11. ,in Hall County,Nebraska,heretofore filed herein,praying for findings of this Court
<br />of the time and place of the death of said Frances E.Kirkpatrick,deceased,that she died in-
<br />testate,for a de termination of who were the heirs at law of said deceased,their degree of
<br />kinship to said deceased,and the right of descent of the real estate owned by said deceased, !i

<br />at the time of her death,and for the settlement of said estate,and the Court having examined
<br />the records and files herein,and listened to the testimony intoduced in support of said pe-
<br />tition,and the Court being now fully advised in the premises,finds that due and legal notice
<br />has been given to all persons,including heirs at law,and creditors of said deceased,of the

<br />time and place fixed by the Court for a hearing upon said petition,by publication thereof for4j
<br />three successive weeks in the Grand Island Daily Independent,a legal newspaper published and
<br />of general circulation in Hall County,Nebraska,as heretofore ordered by the Court,and that
<br />the allegations contained in petitioners! petition are true,and that said Frances E.Kirkpatri''k
<br />departed this life,intestate,at her home in Hall County,Nebra.ska,on the first day of Ma,rch,19�6,
<br />and at the time of her death the said Frances E.Kirkpatrick was a resident and inhabitant of 'I
<br />Hall Count Nebraska•that more than two
<br />Y� , years have elapsed since the death of said Frances E.1
<br />Kirkpatrick,and that no applicationAhas ever been filed in the state of Nebraska for the appojnt-
<br />ment of an administrator of the estate of said deceased,nor has administration upon the estate
<br />of said deceased ever been had or taken in the state of Nebraska;that the said Frances E.Kirk-
<br />pa,trick was a widow at the time of her death and that she left surviving her,as her heir, at
<br />law,and her sole and only heir at law,Kate Darr,a daughter Of said deceased;that said Frances
<br />E.Kirkpatrick died seized as the owner by fee simple title absolute of M undivided one -half
<br />of said north half of the southeast quarter and the south half of the northeast quarter of sai
<br />Section 19 ,in Township 12 North,Range 11 Westin Hall County,Nebraska,and that the same was
<br />of the approximate value of $4000 at the time of the death of said deceased,and that upon the
<br />death of said Frances E.Kirkpatrick said real estate,so owned by her at the time of her death,
<br />passed and descended,under the intestate laws of the state of Nebraska in force at the time
<br />of the death of said Frances E.Kirkpatrick,to said Kate Darr,the daughter of said deceased,
<br />by absolute title;that the petitioners at the time of the filing of the petition herein were
