FINAL DECREE
<br />IN THE MATTER OF

<br />Jahn Ottemoeller,Deceased
<br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA
<br />Now on this 8" day of March,1929,this matter came on for hearing on the final report of
<br />the administratrix heretofor filed,as to due notice by publication as by law and the order
<br />of this Court required,had been given to all persons interested as to the time fixed and
<br />place appointed for hearing said report,and there being no objections on file and noon
<br />appearing in person to object,the Court examined said report and being fully advised in the
<br />premises,finds that the same is correct and that it should be allowed as and for the. final
<br />accounting of the administratrix.
<br />TI IS THEREFORE ORDERED,ADJUDGED AND DECREED that the final report of the administratrix
<br />be,and the same is hereby allowed and approved as and for fer final accounting.
<br />THE COURT FURTHER FINDS that due notice by publication as by law and the order of this
<br />Court required,has been given to all creditors and othere persons interested as to the time
<br />fixed and place appointed for filing claims against said estate and that said time has
<br />' fully elapsed and expired,and that all claims filed against said estate have been paid and
<br />fully satisfied and that any claims not so filed,if any such there be,should be forever
<br />barred and precluded.

<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED that all claims filed against said estate

<br />have been paid and fully sati sf r;'ed and that any ,claims not so f iled, if any such there be,
<br />i should be and the same are forever barred and precluded.
<br />The Court further finds that John Ottemoeller departed this life on the 15th day of Sep-
<br />- tember,1927,while a resident and inhabitant of Hall County,Nebra.ska,and that he died intes-
<br />tate;that he left surviving him as his heirs at law and only heirs at Iaw,Bertha Ottemoeller,
<br />his widow,and Marie Ottemoeller and Raymond Ottemoeller,his children;that at the time of
<br />his death he was the owner in fee of the Southeast quarter of Section Eleven,Township Twelve
<br />i North,Range Nine (W of 11 -12 -9) West of the 6th P.M.,Hall County,Nebraska which premises
<br />were occupied by the deceased as a homestead,and that in addition to such real estate he
<br />was the owner of personal property as listed in the inventory.
<br />The Court further finds that the widow,Bertha Ottemoeller,has paid claims against the
<br />t
<br />estate of the deceased as shown by her final report and that the sum so paid by her together
<br />with her statutory interest in the personal property,exceeds the value of said personal
<br />property and that the personal property should be awarded to said widow to re- imburse her,
<br />for the expenditure she has made,and that the children of said deceased have no interest in
<br />said personal property. That the real estate above described,by operation of law,upon the
<br />death of said John Ottemoeller,did pass and descend to Bertha Ottemoeller,Marie Ottemoeller !
<br />and Raymond Ottemoeller in equal shares subject,�owever,to. the homestead right of Bertha
<br />Ottemoeller,tae widow,in and to said premises.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED that John Ottemoeller departed this life on
<br />the 15th day of September,1927,while a resident and inhabitant of Hall County,Nebraska,and
<br />that he died intestate;that at the time of his death,he was the owner in fee of the South -
<br />east quarter (SEJ) of Section Eleven (11),Township Twelve (12) North,Range line (9) west of
<br />the 6th P.M.,Hall County,Nebraska,and of personal property as shown by the inventory filed '..
