<br />Alve Sutton,Deceased.
<br />Now on this 4th day of January,1929,this matter came on for hearing on the final report
<br />estate of
<br />of Homer Loucks,executor of Alve Sutton,deceased,after due notice by publication as by law
<br />and the order of this Court required,had been given to all persons interested of the time
<br />fixed and place appointed for hearing on said report,and there being no objections thereto
<br />and no one appearing in person to abject,the Court examined said report and being fully
<br />j advised in the premises,finds that the same is in all respects correct and that it should be
<br />allowed and approved.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED that the final report of Homer Loucks,exe-
<br />cutor of the estate of Alve Sutton,be and the same is hereby approved and allowed as and for
<br />his final accounting.
<br />The Court further finds that due notice by publication as by law and the order of this
<br />Court required,has been given to all persons as to the time allowed and place appointed for
<br />filing claims against said estate and that said time has fully elapsed and that all claims
<br />filed against said estate have beenpaid and satisfied and that any claims not so filed,if
<br />any such there be,should be forever barred and excluded.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED that all claims filed against said estate
<br />have been paid and fully satisfied and that any claims not so filed,if any such there be,
<br />should be and the same hereby forever barred and precluded.
<br />The Court further finds that Alve Sutton who was also known as Alva Sutton,departed this
<br />life on the 31st day of July,1928,while a resident and inhabitant of Hall County,Nebxraska,
<br />and that he left a last will and testament which was duly admitted to probate and recorded
<br />in this Court on the 28th day of August,1928;that Homer Loucks was nominated in said last
<br />will and testament as executor thereof and that the following named persons are the heirs
<br />at law of said Alve Sutton,deceased,to -wit:
<br />Martha. Sutton,Areline E.Stevenson,Catharine Fitzsimmons,Minnie Kelly,George Sutton,James
<br />Edward Sutton,John Sutton,and Mary Foley,his brothers and sisters;and Emma Sutton,Ha.nnah E.
<br />Sutton,Mina Sutton,Vinna Sutton,Lotta Sutton,Georgia Sutton,Fra.nk Sutton and Ida Sutton,
<br />children of William Sutton,a deceased brother;Mary Siefken,Ha.nnah Sief$en,Frank Siefken,
<br />Thomas Siefken and Oliver Siefken,children of Jane H.Siefken,a deceased sister;Lottie Sutton,
<br />Hen Sutton and Floyd Sutton,children of Oliver Sutton,a deceased brother;Joseph Sutton,Mary
<br />Sutton,John Sutton,Frank Sutton,George Sutton,Eva Sutton,Theressie Sutton,Irene Sutton,Ce-
<br />celia.Sutton,and Lorence Sutton,chiildren of Thomas Sutton,a deceased brother.
<br />The Court further finds that Alve Sutton was the owner of the fee simple title to the
<br />Northeast quarter of the Northeast quarter (NEJ of the NEJ) of Section Thir #y -four (34) in
<br />Township Nine (9) North,Range Nine (9) West of the 6th P.M.,Hall County,Nebraska, and that
<br />he was possessed of personal property asshown in the inventory filed herein,
<br />The Court further finds that according to the provisions of said last will and testament
<br />of Alve Sutton,deceased,all of said property,both real and personal,was ddvised to Martha
<br />Sutton who is also known as Martha Ann Sutton,to have and to hold for and during her natur-
<br />al life and upon the death of said Martha Sutton to
<br />Areline E.Stevenson,Catharine Fitzsimmons,Minnie Kelly,George Sutton,James Edward Sutton,
<br />John Sutton,and Mary Foley,each an undivided one - eleventh (1/11) part thereof;to
