607 <br />I& 4�� Mall i' <br />'DI JQJ <br />h <br />hearing on the final report and account of Henry Steinbach,executor,and was submitted to <br />Ii the Court ,on consideratimn whereof the Court finds that due and legal notice of hearing has <br />. i <br />i' been given and published as required by law and the order of this Court. <br />i <br />The Court further finds that due and legal notice has been given to the creditors of <br />said estate to file their claims against said estate,and that the time limited for filing <br />claims,as fixed by said notice and the order of this Court,has expired,and that no claims <br />were filed against the said estate. <br />The Court further finds that the funeral charges,expenses of the last sickness of said <br />deceased,and the costs of administration have been paid in full. <br />The Court further finds that the legacy provided for in the last will and testament of <br />said deceased in the sum of One thousand and no /100 Dollars ($1,000.00) to the New Catholic <br />Church fund at St.Libory,Nebraska,and the legacy in the sum of One hundred and no /100 Dollars <br />($100'.00) to be set aside for masses for the Poor Souls in Purgatory have been paid in full <br />and receipts for each of said legacies are on file in this Court. <br />The Court further finds that said estate is fully settled;that said executor has fully <br />accounted forall the property of said estate;that the said report and account filed by him <br />is true and correct in all respects,and should be allowed and approved as his final report <br />and account. <br />The Court further finds from the evidence adduced bearing upon this point that all property ! <br />which the said deceased died seized does not exceed in value the sum of Thirty Thousand and <br />no/100 Dollars ($30,000.00) and that there is no inheritance tax due or assessible against <br />said estate or against any of the heirs,legatees,devisees,or thewidow of said deceased. <br />The Court further finds that after the payment of the funeral charges,costs and expenses <br />as aforesaid,and legacies,there remains in the hands of said executor no cash on hand as <br />appears by the foregoing aceount,and residue consisting of the following described personal <br />property,to -wit: Five (5) horses,fifteen (15) cows,four (4) calves,fazm machinery and one <br />hundred (100 chickens and also the following described real estate situated in Howard County, <br />Nebraska,to -wit: The Southeast Quarter (SEJ) and the South half (S-) of the Northeast Quarter <br />!I(NEJ) of Section Twenty -three (23),Township Thirteen (13),Range Ten (10),and the South half <br />!�5 ) of the Southwest Quarter kswi) of Section Thirty -one (31),Township Thirteen (13),Range <br />Nine (9),and the nest half (W) of the Northeast Quarter (NE-1) of Section Twenty -five (25), <br />ITownship Thirteen (13),Range Ten (10),and the following described real estate in Hall County, <br />;Nebra.ska,to -wit: The South Half (S ) of the Southeast Quarter (SEJ) and the South Half (S� ) <br />of the Southwest Quarter (SWJ) of Section Twenty -three (23),Township Twelve (12),Range Ten <br />(10),West of the 6th Principal Meridian. <br />The Court further finds that the said John B.Steinbach died on the 9th day of June 1928, <br />near St.Libory,Howard County,Nebraska,and a resident of Howard County,Nebraska,leaving a last <br />will and testament,and which said last will and testament of said deceased was duly proved in <br />and before the County Court of Howard County,Nebraska,according to law,as the last will and <br />,,testament of the real and personal estate of said deceased,and the same was duly admitted to <br />probate and recorded in my office on the 7th day of July,1928;that by the terms of said last 0 <br />will and testament after the payment of just debts,funeral expenses and expenses of adminis- <br />tering said estate,and after the payment of the bequest to the New Catholic Church fundost. <br />Libory,Nebraska,of One thousand and no /100 Dollars ($1,000.00) and the payment of One Hund- <br />red and no /100 Dollars ($100.00) to be set aside for masses for the Poor Souls in Purgatory, II <br />all of the real estate and personal property, of said deceased was given to his widow,Anna <br />G.Steinbach,and after her death the property to be divided as follows: To his grandson,George <br />
