DECREE. of Arthur Zbinden, Deceased. Now,on_ this 20 day of Becember,1928,this cause came on for hearing upon the petition of John J.Ross,petitioner hereinpraying for settlement of the estate of said deceased,and det- ermination of his heirs at law,and right of descent of said real estate,and the degree of kir skip of said heirs at la.w,and it appearing from the proof on file herein that due and legal notice by publication for three consecutive weeks,as by law and the order of this Court re- quired,has been given to all heirs at law,creditors,and other persons interested in said estate of the filing of said petition and the time and place for hearing same,which time was more than thirty days and less than sixty days after the filing of said petition,and there being no objection thereto the cause was duly submitted to the Court upon said petition and the evidence,and the Court,being first duly advised in the premises,finds that the allegatior, in the petition are true,that said Arthur Zbinden died intestate ont he 8th day of September, 1924,and that on the date of his death he was a bona fide resident of Hall County,Nebraska; that at the time of his death he was the owner of the said real estate herein described in Hall County,Nebraska;that more than two years have elapsed since his death,a,nd that no appli tion has been made in the state of Nebraska for the appointment of an administrator of said estate,and no administration has been had of said estate. The Court finds that said deceased left surviving him the following and only heirs at law to -wit; Elsie Zbinden,widow,Ferne Zbinden,daughter,Jason 3binden,son,and Bessie May Zbinden, daughter. The Court finds that said Arthur Zbinden died seized of the following described real estat,o; Lot Six (6) in Block Fourteen (14) of Baker's Addition to the city of Grand Island in Hall !! County,Nebraska,which said real estate did pass and descend,on the date of the death of said Arthur Zbinden,by operation of law,to the following named heirs at law as follows; Elsie ZbirGden, widow,a,n undivided one -third interest;Ferne Zbinden,Jason Zbinden,and Bessie May zbinden,eacY an undivided two - ninths interest ,subject,however,to the homestead interest therein which pas.ed and descended by operation of law to Elsie Zbinden,surviving widow of said Arthur Abinden, 11 1 deceased. The Court further finds that no petition or application has been filed in the state of Nebraska for the appointment of an administrator of the estate of said deceased,and that no administration has been had upon his estate in the state of Nebraska,and that more than two years have alapsed since his death,and that he died intestate,and that his funeral expenses have been paid,and that all debts of Said deceased,and his estate,have been paid,and are forever barred and precluded,and that the costs of this proceeding have been paid. The Court further finds that the petitioner herein,John J.Ross,is the owner by fee simple title of said real estate,and that he derived title to said real estate by direct and mesne conveyances,and is duly authorized by law to make this application in this Court. IT I5,THEREFORE,BY THE COURT ADJUDGED,CONSIDERED,AND DECREED that said Arthur Zbinden diec intestate more than two years prior to the filing of the petition _herein,that no , applicatior the appointment of an administrator of his estate has been made in the state of Nebraska,or elsewhere,nor has there been any administration of his estate in the state of Nebraska,or elsewhere,and that he died seized in fee simple of the following described realestate,to -wit; Lot 6,in Block 14,of Baker's Addition to the city of Grand Island,in Hall County,Nebraska;th, __ ____he_ left ___surviving him,as his sole and only heirs at law,the following named; Elsie Zbinden, t for
