434. <br />-WID DDEMEMM MOUVE-MIE <br />JOURNAL COMPANY, LINCOLN, NEB. <br />terest of #809.40 in the $1500.00 note of the Dolan Fruit Company,and that her son,Alvin Del <br />mont Andersen has an interest of $690.60 in said note. <br />The court further finds that there is left in the custody of the said Administtatrix,C.T.A'i <br />the following items of person Al property,to -wit: <br />50 shares of Equitable Building & Loan Assn.of Grand Island,Nebraska,paid -up capital stock» <br />15 shares of Occidental Building & Loan Assn.paid -up capital stool; <br />50 share of Equitable Building & Loan Assn.running stock; <br />12 shares of Nelson Lumber & Supply Co.eapital stock ;and one note of Dolan Fruit Co in the' <br />sum of $1500.00. <br />The court further finds that said Jens Andrew Andersen left a last will and testament,whioh <br />was on June 2,1927 duly admitted to probate;that thereafter,to -wit on the 2nd day of June,192? <br />Dorothea Andersen,widow of the said Jens.,Andersen did file in the office of the County Judge <br />of Hall County,Nebraska,an election to take under the statute,in writing,which election was <br />duly witnessed and acknowledged in the manner and form provided by law,and thereby did elect <br />to take under the statute of descent and distribution of the laws of the State of Nebraska, <br />and did elect to take the interest which would have passed to her,had said Jens Andrew <br />Andersen died intestate. <br />The court further finds that the said Jens Andrew Andersen died leaving as his heirs at lair <br />and his only heirs at law,his widow,the said Dorothea Andersen,add his son,Alvin Delmont <br />Andersen,five yeazs of age at the time of the death of the said Jens Andrew Andersen,and that <br />by virtue of the said election by the said Dorothea Andersen to take under the state of dis- <br />tribution,the entire estate of the said Jens Andrew Andersen did pass as intestate ptoperty. <br />The court further finds that the said Dorothea Andersen,widow,has received her widow's <br />allowance and by the adjustment heretofore set forth,has received the allowance of specific <br />personal property,to which she is entitled by statute,and thatshe has received the household <br />furniture and personal effects of the deceased to which she' is entitled by law. <br />The court further finds that all debts have been paid,all expenses of administration have <br />beenpaid,that said estate is not subject to inheritance tax,either Federal or State. <br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED by the court that the following items of <br />personal property ,to -wit: <br />50 shares of Equitable Bldg.& Loan Assn.paid -up capital stock; <br />= 15 shares of Occidental Bldg.& Loan Assn.paid -up capital stock; <br />50 shares of Equitable Bldg.& Loan Asen.running stock;and <br />12 shares of Nelson Lumber & Supply Co.capital stock. <br />be divided share and share alike between Dorothea Andersen and Alvin Delmont Andersen,and that <br />the note of the Dolan Fruit Co.in the principal sum of $1500.00 be divided as follows: $809.40 <br />to Dorothea Andedsen,and $690.60 to Alvin Delmont Andersen,and that upon the filing-of receipts <br />for said personal property by the parties entitled thereto,the said Dorothea Andersen,Admini- <br />stratrix,C.T.A.be discharged as such Administratrix and her bondsman released. <br />The Court further finds that the said Jens Andrew Andersen departed this life on the 3rd <br />day of May,1927,being at the time of his death a resident and inhabitant of Hall County,Nebraska, <br />and that he left him surviving as his heirs at law and his only heirs at law,Dorothea Andersen, <br />his widow,and Alvin Delmont Andersen,his son,and that at the time of his death,he was owner <br />in feel of the following described real estate, <br />The Southerly 48 feet of Lot Five (5),in Block Eighteen (18),in H.G.Clark's Addition to <br />the City of Grand Island,Hall County,Nebraska, <br />which was the home and homestead of the said Jens Andrew Andersen and his wife and family. <br />
