<br />IN THE COUNTY COURT OF HALL COUNTY,NEBRkSKA.
<br />In the Matter of the Estate of
<br />John L.Klein,also known as DECREE.
<br />J.L.Kline,Deoeased.
<br />BE IT REMEMBERED,that on this 28th day of June,A.D.21927,this matter came on for hearing
<br />upon the petition of Mary Klein praying for a degree of heirship in the above entitled estate
<br />and it appearing to the court from proofs on file in this office that due and legal notice,
<br />as is required by law and the former order of this court,has been given of the time and place!
<br />of this hearing by publication in the Grand Island Daily Independent,a legal newspaper publish
<br />in the city of Grand Island,Hall County,Nobraska,and the court being fully advised in the
<br />premises,finds:
<br />1.
<br />That John L.Klein died intestate,a resident of and domiciled in Hall County,Nebraska,on
<br />8th day of April,A.D.,1927,18aving surviving him a wife,Mary K1ein,of Doniphan, Nebraska, and
<br />the following named childregto -wit: John G.Klein,of Doniphan, Nebraska, Clareno e E.Klein,of
<br />Goodland,Kansas,William A.Klein,of Doniphan,Nebraska,Orville M.Klein,of Goodland,Kansas,Raymo�
<br />f L.Klein,of Doniphan,Nebraska,sons,and Mrs.Marie G.Sproul,of Norton,Kaneas,a daughter;that he

<br />left no other living children or the living issue of any deceased children,or any other per:fl o
<br />who are heirs of his estate and interested therein;that the said Mary Klein was the mother
<br />all of said named children.

<br />That the said John L.Klein died seized and possessed of the following described real estatO
<br />to -wit:
<br />Commencing at the Southwest corner of Section four (4),in Township nine (9),North of Range)
<br />nine (9),West of the 6th P.M.,in Hall County,Nebraska,runningthence East twelve (12) rodst'
<br />thence North eighteen (18) rods;thence West twelve (12) rods;thence South eighteen (18) rods
<br />to the place of beginning.

<br />That in the deed to said premises,dated June 2,1926,and filed for record on June x,1926,
<br />in Book 62 on Page 577 of the deed records of Hall County, Nebraska, the said John L.Klein,de-
<br />ceased,was erroneously and by mistake named and designated as J.L.Kline;that his true and
<br />correct name,,was.John L.Klein,and that he was the same and identical person as erroneously n
<br />and designated by mistake in said deed as J.L.Kline,notwithstanding the discrepancy in the n
<br />iv.
<br />That the above described real estate was at the time of the death of said John L.Klein,de-
<br />ceased,00cupied by him and his family as and for a homestead,and is wholly exempt from a tt
<br />execution or other mesne process,and not liable for the debts of said decedent;that the valuellof
<br />said real estate is less than $2000;00;that there is no personal property belonging to the
<br />cedent,and that all debts,char #es and expenses against said estate have been paid;that there si
<br />is no inheritance tax due the state'of Nebraska,or estate tax due the United States of Amerie.
<br />V.
<br />That the above described real estate descended and vested by operation of law in the above
<br />named heirs,as follows: To Mary Klein,the use,income and occupancy thereof during her naturi:k
<br />'? life as a homestead,and an undivided one -third in fee,and to John G.Klein,Clarence E.K1ein,Wi liam
<br />y'
<br />A.K1ein,Orville M.Kiein,Raymond L.Klein,and Mrs Marie G.Sproul,to each an undivided one - ninth
<br />in fee,subject to the homestead rights and life estate of said Mary Klein,wije of said John
<br />L.Klein,deoeased. j
