<br />,1927,this cause came on for hearing upon the report
<br />and petition of Charles X.Miller,executor of the estate of Aaron Miller,deoeased,for final
<br />f settlement and distribution and for his discharge as such executor,and the evidence,and was
<br />j submitted to the Court

<br />ON CONSIDERATION WHEREOF the Court finds from the proofs on file,the records and the
<br />evidence:
<br />1.That due and legal notice of this hearing was had by publication according to law.
<br />2.That seL d Aaron Miller departed this life testate in said county on the -28th day of
<br />September ,1926.

<br />3.That on the 20th day of Ootober,1926,a paper writing purporting to be the last will
<br />j and testament of said Aaron Miller,deoeased,together with a petition praying for the pro -
<br />bate of the same was duly filed in this Court.
<br />4.That on the 16th day of November,1926,after notice thereof had been duly given aocordingli
<br />to law,said will was by this Court duly admitted to probate and a decree was entered proving,!

<br />approving,probating and allowing said instrument as the last will and testament of said Aaron!
<br />Miller,deceased,and directing that Letters Testamentary issue to Charles X.Miller upon his
<br />taking a filing oath as required by law,and filing bond in the sum of $500.00,with sureties
<br />j to be approved by this Court.
<br />Said will,together with the Certificate of probate thereof,being in words and figures
<br />following,to wit:
<br />LAST WILL AND TESTAMENT OF AARON MILLER.
<br />I,Aaron Miller,of South Platte township,county of Hall,in the state of Nebraskado make,
<br />publish and declare this as and for my last will and testament,that is to say:
<br />ff I give and bequeath unto my wife,Ella L.Miller,all of my personal property,of every kind

<br />and desoription,but direct that all of my debts,including the mortgage for one thousand doll -
<br />are now upon part of my real estate,shall .first be paid from such personal property.
<br />I give and devise unto my wife,Ella L.Miller,the southwest quarter of section twenty nine
<br />and the undivided half of the northwest quarter of section thirty two,all in town nine,range
