31x0 <br />ii <br />an order fixing the 19th day of April,1927,at 10 o'clock A.M.,as the time of hearing for.said <br />Decree of Distributionsettlement and allowance of an Executors a000unt,and the discharge of <br />Executor from his Trust,and ordered that Notice of said hearing be given by publishing a Noti <br />thereof in the Paxton Times for three successive weeks prior to the 18th day of April,1927. <br />(17).The Court further finds that on the 22nd day of March, 1927,J.G.Limbaugh,the widpwer <br />of said Emma Limbaugh,Deoeased,filed an election in said Court refusing to take the property <br />awarded him under the provisions of the last Will and Testament of Emma Limbaugh,deoeased, <br />and relinquisheJ and released all right as such legatee and devisee and elected to take under <br />the terms of the Statute of the State of Nebraska, <br />(19).The Court further finds from the proof of publication duly filed on the lath day of <br />April,1927,that due and legal notice of said final hearing in said estate was given by publi <br />tion of a Notice thereof for five consecutive weeks immediately preoeeding the 18th dayof <br />April,1927,in the Paxton Times,a legal weekly newspaper,printed and publis,t Paxton,Keitx <br />County, Nebraska, the first publication having been made on the 18th dale of r �r 1'927 and the <br />last publication on the 15th day of April,1927,and that this hearing is held in pursuants of <br />said Notice and Order. <br />(19). The Court further finds that on the Inventory filed in said proceeding there is a A <br />note shown as an asset of said Estate made by J.L.Williams to Emma L-imbaugh,for the sum of <br />$679.20. <br />(20).The Court further finds that said note was included in and made a part of the note <br />for $995.00 also shown in said Inventory,and thet said J.L.Williams only owes to said Estate <br />the one note for $985.00 instead of the tiro -notes as shown by the inventory. <br />(21).The Court further finds that the Final Report of said Executor is correot,except as <br />shows two notes of J.L.Williame.one for $985.00,and one for $679.20,uncolleoted,and that <br />note of $679.20 was included in the note of $985.00,as above set forth,and is not an asset <br />of said Estate. <br />t22). The Court further finds that all claims against said Estate which have been filed,.. <br />except the claim of J.G.Limbitugh,hate been paid in full. That there is due to said J.G.Limba <br />upon said claim filed by him and unpaid,the sum of $264.66. That there is due to the Paxton_ <br />Cemetery Association remaining unpaid for cemetery lot,the sum of $ ;0.00.Tbat there is due t <br />Paxton Times for publishing legal Notice and unpaid, the sum of $11.18.That there is due to <br />the County Court of Keith County,Nebraska,the sum of $50.00,as Court costs in said Estate. <br />That there is due to L.A.Devoe,as Attorney in said Estate,the sum of $200.00 for Attorneys <br />fees.That there is due to J.G.Limbaugh for recording certified copies of this Decree and De <br />the sum of $10.00;, <br />(23).The Court further finds that the heirs -at -law of Emma Limbaugh,deoeased,4re J.G.L <br />Widower,the second husband of said Emma Limbaugh,and not the father of all tte children of s <br />Emma Limbaugh.Ella M.Tripp,Myrtle J.Havens,and Nellie T. Vanarsdall ,daughters;J.L.Williams,Ha <br />E.Williame.and Thomas C.Williams,sone,and Dallas Allison,Harriett Alllson,Leonard Allison, <br />Frances Allison,William Allison,and Marjorie Allison,ohildren of a deceased daughter Daisy <br />Allison. <br />(24).The Court further finds that at the date of the death of said Emma Limbqggh,she was <br />seised in fee simple of Lot. Nine (9),in Block Sixteen (16) of Rollins Addition to the City <br />Grand IslandHall County,Nebraska,and the East Half (E*) of Lot Eleven (11),and all of Lot <br />Twelve (12) in Block Seven (7) of the original Town of Paxton,Keith County,Nebraska. <br />(25).The Court further finds that the East Half (E4) of Lot Eleven (11) and all of Lot <br />Twelve (12) in Block Seven (7) of the original town of Paxton,Keith Courty,Nebraska,was the <br />I <br />the <br />I <br />gh, <br />d <br />y <br />
