<br />and Clara Stolley,in a portion thereof,and that on the death of said Otillie Stolley,the real
<br />estate above described passed and descended,under the intestate laws of the state of Nebraska

<br />in force at the time of the death of said Otillie Stolley,to said Wilhelmine Frederika Stolley
<br />ii the mother of said deceased,by absolute title•that the petitioner Emil Stolle

<br />ii filing said petition herein,was the owner of an undivided one- eighth of the real estate herein
<br />before described,and was a competent and proper person to prosecute this proceeding;that the
<br />funeral expenses of said deceased,and the debts of said deceased and the costs of this pro -
<br />ceeding,have been fully paid,and if any debts existed against the estate of said deceased the
<br />1 same have long since been barred by the Statute of Limitations of the state of Nebraska in sue;
<br />cases made and provided;that the estate of said deceased is not subject to an inheritance tax
<br />under the laws of the state of Nebra.ska,nor is it subject to'a Federal estate tax under the
<br />laws of the United States,and that the petitioner is entitled to a decree as prayed in his pe-
<br />tition.

<br />IT IS,THEREFORE,ORDERED,ADJDDGED AND DECREED BY THE COURT that the said Otillie Stolle

<br />departed this life,intestate,in Hall County,Nebraska,on the 14th day of MardIL,1922,and that
<br />at the time of her death she was a resident and inhbitant of Hall County,in the state of Nebra�
<br />that more than two years have elapsed between the date of the death of said Otillie Stolley
<br />and the filing of the petition herein;that no application or petition has ever been filed for
<br />l administration upon the estate of said deceased in the state of Nebraska nor has the estate
<br />{of said deceased ever been administered upon;that said Otillie Stolley left surviving her,
<br />ias her heir at law and her sole and only heir at law,Wilhelmine Frederika Stolley,her mother;
<br />;that said Otillie Stolley died seized as the owner,by The simple title,absolute,of the real
<br />i
<br />estate hereinbefore described,and that upon her death the same passed and descended,under the
<br />;intestate laws of the state of Nebraska in forde at the time of the death of the said Otillie
<br />Stolley,to Wilhelmine Frederika Stolley,her mother,by absolute title;that the petitioner;Emil
<br />iStolley,at the time of filing the petition herein was the owner of an estate of inheritance
<br />inthe real estate hereinbefore described,and was a competent and proper person to presecute thi
<br />,proceeding for the purpose of determininithe time and place of the death-of said deceased,that
<br />;she died intestate,of determining who were her heirs at law,their degree of kinship to her,
<br />and the right of descent of the real estate owned by said deceased at the time of her death..,
<br />and for barring claims against said estate,and that said estate is not subject to an inheritanc
<br />;tax under the laws of the state of Nebraska,nor to a Federal estate tax under the laws of the
<br />'united States.
<br />i IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all debts of said Otillie Stoll
<br />deceased,if any such exist,are forever barred and precluded,and that further administration
<br />iof the estate of the said Otillie Stolley,deceased,is hereby dispensed with,and the estate
<br />iof the said Otillie Stolley,deeeased,is hereby forever settled and closed.
