DECREE <br />IN THE COUNTY COURT OF HALL COUNTY NEBRASKA <br />IN THE MATTER OF THE ESTATE <br />OF DECREE <br />GEORGE A.BURGER,DECEASED <br />Now on this 6th day of November,1926,this cause came on for hearing upon the petition of <br />Mabel Pentico heretofore filed herein,praying for a settlement of the estate of said deceased, <br />a determination of the heirs of said deceased and degree of kinship and the right of descent <br />d)f his real estate,said petitioner being represented by Horth,Cleary & Suhr,her attorneys, <br />and it appearing from 'the proof on file that due and legal notice of publication in "The <br />Grand Island Daily Independent. "a legal newspaper in Hall County,Nebraska,for three conse- <br />cutive weeks,as by law and the order of this court required,has been given to all creditors, <br />heirs -at -law and persons interested in said estate of the filing of said petition and the <br />timeand place for hearing thereof,which time was more than thirty days and less than sixty <br />days after the filing of said petition,and there being no objection thereto,said cause was <br />duly submitted to the Court on said petition and the evidence of the petitioner in support <br />thereof and the Court being duly advised in the premises finds that the allegations in said <br />petition are true,that the said George A.Burger died intestate in Hall County,Nebraska,on <br />the 27th day of September,1913,and at the time of his death he was a resident and inhabitant <br />of said Hall County,Nebraska;that more than two years have elapsed since his death and <br />no application has been filed in the State of Nebraska or elsewhere for the appointment of <br />an Administrator of his estate nor petition filed therefor and that no administration has <br />been had upon his estate at any place. <br />The Court finds that the deceased left surviving him as his sole and only heirs -at -law, <br />the following named widow,son and daughters,all being of legal age,to -wit: <br />Rosa A.Burger,his widow,of Hall County,Nebraska; <br />Mabel Pentico,a daughter,of Lancaster County,Nebraska; <br />Edwin C.Burger,a son,at that time a resident of Hall County,Nebraska,now of Long Beach, <br />California; <br />Celia Rapp,a daughter,at that time a resident of Hall County,Nebraska,now a resident of <br />Whittier,California; , <br />Mildred Rensimer,a daughter,at that time a resident of.Twin Falls County,Idaho,now of <br />Glendale.,California; <br />Rozilla Westfall,a daughter,of Carmen,Oklahoma; <br />Grace G.Burger,a daughter,a resident of Hall County,Nebradka,now deceased. <br />4 <br />That the said Rosa A.Burger,widow of said deceased was not the mother of all of the above <br />mentioned children;that she was the mother of the above named Mabel Pentico,Edwin C.Burger <br />and Grace G.Burger but not the mother of the above mentioned Celia Rapp,Mildred Rensimer and <br />Rozilla Westfall and by reason whereof the said Rosa A.Burger,widow,under the law of des- <br />cent in force in the State of Nebra0ka,took an undivided one - fourth (yi) interest in the <br />premises hereinafter described. <br />That the said deceased died seized as the owner of an estate of inheritance in and to the <br />following described premises,situated in Hall County,Nebraska,to -wit: <br />The East Half of the Southeast Quarter (Zi SE�) of Section Four (4),Township Nine (9) <br />North,Range Nine (9),West of the 6th P.M.in Hall County,Nebraska. <br />That said real estate did,on the death of the said George A.Burger,pass and descend by <br />operation of law,under the law of descent in force in the State of Nebraska,to the following <br />named,p o orti ns,to -wit: To Rosa A.Burger,an undivided one - fourth (J) interest therein to <br />Mabel Pentico,Edwin C.Burger,Celia Rapp,Mildred Rensimer,Rozilla Westfall and Grace G.Burger, <br />each an undivided one- eighth (1/9) interest therein,all subject to the homestead rights of <br />;;the above mentioned widow,Rosa A.Burger,and all holding as tenants in common,the above mend <br />i <br />
