<br />Now,on this 26th day of February,1927,this cause tame on for hearing upon the petition of j
<br />William H.Thompson,who derived title and an interest in and to the premises herein described
<br />y
<br />mesne conveyances from and through the heirs :at law of said deceased, praying for a settlements;
<br />of the estate of said Michael Ellington,deceased,a determination of his heirs and the right off'
<br />descent of his real estate and the degree of kinship of said heirs at law,and it appearing from
<br />the proof on file herein that due and legal notice by publication for three successive weeks
<br />R;
<br />as by law and the order of this Court required,has been given to all creditore,heirs at law,
<br />and persons interested in said estate,of the filing of said petition and of the time and plaoO
<br />for nearing same,which time was more than thirty days and less than sixty days after the
<br />filing of said petition,and there being no objection thereto ,the cause was duly submitted to the
<br />Court upon said
<br />p petition and the evidence ,and the Court being duly advised in the premises , finds
<br />that the allegations in the �•
<br />g petition are true ,that said Michael Ellington died intestate on tlie
<br />11th day of August,1091,at his place of residence in Hall County,Nebraska,and that at the time
<br />of his death he was a resident and inhabitant of Fia,ll County,Nebraska;that at the time of his:;
<br />death he was the owner of certeiin real estate in Hall County,Nebraska;that more than two year
<br />have elapsed since his death;that no application has been :Wade in the state of Nebraska for tide
<br />appointment of an administrator of his estate and no administration has been had of said estate.
<br />The Court further finds that said petitioner,William H.Thompson,and his wife,Nettie I.ThompIson,
<br />as joint tenants with right of survivorship,and not as tenants in common,are the owners in fell

<br />simple of said real estate and that said William H.Thompson derived title and said interest ini
<br />and to said real estate by mesne conveyances from the heirs at law of said deeeased,and is a
