The Court further finds that the estate of the said Katharina Ha.rdekopf,deceased,was not subject to the payment of any inheritance tax under the laws of the State of Nebraska,and tha the said Fred D.Hardekopf,as such administrator has paid the funeral expenses of the said deoeased,the debts against the estate of said deoeased,the costs of this proceedings and all claims and special bequests as provided for in said last Will and Testament. The Court further finds that "Katherina" Hardekopf as the name appears in the said last Will and Testatement and "Katharina" Hardekopf as the name appears in the petition for pro- bate and " Katharena" Hardekopf as the name appears in the final decree filed in the estate of Fred W.hardekopf,deceased,husband of the deceased herein,and in which name the title to the above described premises appears of record,are all one and the same person and that said names all designate the same person,the discrepancies in spelling and names notwithstanding. The Court further finds that the said Fred D.Hardekopf has performed all and singular every condition and request contained in the last Will and Testament of the said Katharina Hardekopf,deceased,and that no money remains in the hands of the said executor,and that the said estate should be closed and the executor discharged. IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the said Fred D.Hardekopf,as executor of the last Will and Testament of the said Katharina Harde kopf,deceased,be and the same is hereby approved and allowed as and for said last report, said estate -is hereby settled and closed and said executor is discharged and his bond release. IT IS,THEREFORE,FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that claims against said estate are forever barred,that said special bequest as provided in said Will has been paid,and that all legatees in said last Will and Testament hate been paid and that there is nothing due any of them from said estate. IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that the said Meta von Aschwege, Adele Neumann,William Hardekopf,August Hardekopf,and Fred Hardekopf,are the children of said Katharina Hardekopf,deceased,and the only heirs at law of the said deeeased;that said Kathar- ina Hardekopf was a widow at the time of her death;that the said children have agreed in writing upon the sale price and purchaser of said Lot Six (6) Block Seventeen (17) of the Original town,now City of Grand Islan d,Nebraska,and that the said executor was authorized to sell said property at pritate sale to the said H.C.von Aschwege qnd was authorized and empow- ered to give a good and sufficient deed to said premises.
