<br />premises the Court finds that said report is true and correct in all things and that the s amo

<br />The Court further finds that Katharina Hardekopf departed this life testate,on the 14th
<br />day of April,19�26,and at the time of her demise was a resident and inhabitant of Hall County,!;
<br />Nebraska.
<br />The Court further finds that on the 20th day of April,19262Fred D.Hardekopf,a son of said
<br />deceased,filed in this Court his duly verified petition praying for the allowance and probate'
<br />i
<br />of an instrument purporting to be the last Will and Testament of the said deceased ;that the f'
<br />Court thereupon fixed the 20th day of May,1926,as the day of making proof of said Will and dine
<br />i
<br />notice of the filing of said petition and of the time and place fixed for hearing thereon wasiduly
<br />given by the Court in the manner as provided by law and on the 20th day of April,1926,being the date
<br />fixed for that purpose,said instrument was duly proven allowed and admitted to probate in thi1
<br />�f
<br />Court as and for the last Will and Testament of the said Katharina Hardekopf,deceased,and the,;
<br />said FredDHardekopf,who was named in said Will as executor thereof was appointed and he is duly
<br />qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the timo
<br />and place fixed by the Court for the presentation of claims against the said estate and the
<br />time so fixed has fully expired and that all persons having claims against said estate,if any'
<br />such there be,are foreibet barred and excluded from setting up or asserting any such claims
<br />against said estate.
<br />The Court further finds that the said Katharina Hardekopf died seized as the owner in fee is
<br />simple of the following real-estate situated in Hall County,Nebraska,to- wit: Lot six (6)
<br />Block Seventeen (17) of the Original Town now City of Grand Island,Nebraska,and that the said]
<br />real estate was ordered,by a provision of the last Will and Testament of said Katharina Hardee•
<br />kopf,to be sold by the executor. The Court further finds that all of the children and lawful'`!
<br />heirs of said Katharina Hardekopf,deceased,having agreed in writing upon the sale price and tie
<br />purchaser of said property by an instrument on file with this Court,and that the said a xecuto*

<br />had authority to and did sell said real estate at.private sale to H.C.Von Aschwege for the sugl
<br />of $2900.00 and has given a good and sufficient deed to said property to said purchaser.
<br />The Court further findsathayt said deceased left surviving her as her heirs and only heirs at
<br />law the following ,to -wit: Meta vonAschwege,Adele Neumann,William Hardekopf,August Hardekopf ,arid
<br />Fred Hardekopf,, The last named being the executor of said last Will and Testament and %h o heroin
<br />appears by the name of Fred D.Hardekopf,and that all of the said children and heirs at law are
<br />of legal age. The Court further finds that said Katharina Hardekopf,deceased,at the time of her
<br />death was a widow and 16-ft surviving her no spouse.
<br />The Court further finds that all of said real estate after the payment of all lawful claims
<br />and expenses and the special bequest of $300.00 named in said Will,descend in equal shares to
<br />the said heirs;namely,Meta von Asohwege,Adele Neumann,William Hardekopf,August Hardekopf and
<br />Fred Hardekopf.
<br />The Court further finds that the said Executor,Fred D.Ha.rdekopf,has paid to Fred Hardekopf,
<br />special 1-gatee in said Will,the sum of $300.00 and that his receipt for same is on file with
<br />with this Court.
<br />The Court further finds that the said executor,Fred D.Hardekopf,has on hand after the payment
