241 <br />INC 4- Z-All UJOVAIUM , <br />IN THE MATTER OF THE ESTATE OF <br />MARGARETHA LINDEMANN FINAL DECREE. <br />DECEASED. <br />Now on this 24th.day of January,1927,this matter came on for hearing upon the final report <br />of the Executor hereinbefore filed after due notice by publication as by law and the orders <br />of this Court required,had been given to all persons interested as to the time fixed and <br />place appointed for hearing said repott,and there being no objections on file,and no one <br />appearing in person to objeot,the Court examined said report and from such examination finds <br />the same to be in all things correct,and that the same should be approved and allowed as <br />and for the final accounting of the Executor. <br />i <br />C IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the final report of the Executor <br />j herein filed be and the same is hereby approved and allowed as and for his final accounting. <br />The Court further finds that due notice by publication as by law and the orders of this <br />Court required,had been given to all creditors and persons interested in said estate as to <br />the time fixed and place appointed for filing claims against said estate,and that said time <br />has fully elapsed and expired,and that all claims filed against said estate have been paid <br />and fully satisfied and that any claims not so filed,if any such there be,should be and the <br />same are hereby forever barred and precluded. <br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that all claims filed against said estate <br />t! have been paid and fully satisfied,and that all claims not so filed,if any such there be, <br />should be and the same are hereby forever barred and precluded. <br />The Court further finds that Margaretha Lindemann departed this life on the 11th day <br />of Maroh,1926,while a resident and inhabitant of Hall County,Nebraska,and that she left a <br />last will and testament which was duly admitted to probate in this Court on the lOth.day of <br />Apri1,1926,and is now of record in this office. That said Margaretha Lindemann left surviving <br />her as her heirs at law and only heirs at law,Alexander Lindemann and Hani Lindemann,her <br />sons,Max Tschauder,Hild4gard Techauder Sohneider,and Ernest Tsohauder,her grandohildren,,being <br />children of a deceased daughter,Hildagard Tsohauder. <br />The Court further finds that said Margaretha Lindemann at the time of her death was the <br />owner in fee of part of Lot Nine (9) of the County Sub - division of the West Half of the <br />Southwest Quarter (Wj SWJ) of Section Fifteen (15),Township Eleven (11),North,Range Nine <br />r <br />(9) West of the 6th P.M.,more particularly described as follows. <br />Commencing on the South boundary line of said Lot Nine (9),at a point 33 feet East of <br />the Southwest corner of said lot Nine (9),where the East line of Locust intersects said <br />boundary line,thenoe East along said South boundary line of said Lot Nine (9),127 feet,thenoe <br />t <br />North at right angles 60 feet,thenoe West at right angles 127 feet to the East line of Loft <br />I <br />oust Street,thenoe South along the East line of Locust Street 60 feet to the place of beginni <br />i <br />and that she was possessed of personal property as shown in the inventory. <br />,i <br />The Court further finds that according to the provisions of the last will and testament <br />j of the deceased,said real estate was devised -to Arthur C.Mayer in t rust,and by him to be <br />sold as directed by the children of the deceased and the proceeds devided in the proportions <br />set out in said will. <br />The Court finds that said real estate has been sold by said Arthur C.Mayer and that it <br />was sold at the direction and with the consent and approval of the children of the deceased, <br />and that said sale and the proceedings had thereunder were in accordance with the provisions <br />of said last will and testament and in conformity with the desires of the testatrix,and <br />that said sale should be approved. <br />
