<br />IN THE MATTER OF THE ESTATE
<br />OF FINAL DECREE.
<br />AUGUST WITZKE,DECEASED.

<br />Now on this 12th day of January,1927,this cause came on for hearing upon the final report
<br />of Martin Witzke,Administrator of the estate of August Witzke,deceased,and the Court, having
<br />examined the records and files and being fully advised in therpremises finds that due and
<br />legal notice has been given to all persons interested in said estate of the time and place
<br />fixed for hearing upon said report as heretofore ordered by the Court.
<br />And the Court having examined the final report together with all other files,and the
<br />testimony offered in support thereof,finds that the said report is true and correct in all
<br />things and ought to be allowed and approved as and for the final report of said Administrator
<br />The Court further finds that the said August Witzke departed this life at his home in
<br />Grand Island Hall County,Nebraska on the 30th day of April,1926,and at the time of his
<br />death was a resident and inhabitant of Hall County,Nebraska ;that he died intestate and that
<br />he left surviving him as his heirs at law and his only heirs at law the following named -
<br />persons :Augusta Witzke,surviving widowand Martin Witzke,his son,both residing in Hg11
<br />County,Nebraska.
<br />THE COURT FURTHER FINDS that the said August Witzke,was at the time of his death the
<br />owner in fee of the following described real estate situate in the County of Hall and State
<br />of Nebraska,to -wit:
<br />The West Half of the East Half and the Northeast Quarter of the Northwest Quarter of
<br />Section 3,Township 12,North,Range 10,containing 220 acres mor or less ;Hall County.
<br />East Half of the Northwest Quarter of Section 10,Township 12,North,Range 10,West of the
<br />6th P.M.in Hall County,containing 90 acres more or less;
<br />The Southwest Quarter;and the South Half of the Northwest Quarter ;and the Northwest
<br />Quarter of the Northwest Quarter,all in Section 3,Township 12,North,Range 10,West of the
<br />6th P.M.in Hall County,Nebraska,containing 280 acres,more or less.
<br />The Court further finds that under the law of descent of Real Estate in the State of
<br />Nebraska,all of the above mentioned and described real estate did pass and descend at the
<br />death of the said August Witzke,intestate,to the said Augusta Witzke and Martin Witzke,in
<br />equal shares and in absolute title,the latter however,taking subject to the homestead right
<br />of the said Augusta Wit zke, widow, therein. ~
<br />IT IS,THEREFORE CONSIDERED,ADJUDGED,AND DECREED that all of the above mentioned and-des-
<br />cribed real estate did pass and descend,under and by virtue of the law of descent of real
<br />estate at the death of the said August Witzke,in the manner following; to wit:
<br />To Augusta Witzke,widow,one -half, thereof; -
<br />To Martin Witzke,son,one -half thereof,subject to the homestead right of the said widow
<br />in and to said real estate,and it is accordingly awarded to them.
<br />THE COURT FINDS that the Inheritance Tax assessed against the beneficiaries has been paid.
<br />THE COURT FURTHER FINDS that the personal property belonging to said deceased has been
<br />distributed according to law as shown by the receipts of the heirs now on file in this office.
<br />THE COURT FINDS that notice As required by law was given to all creditors of said deceased
<br />as to the time allowed and place appoi*ted for filing claims against the estate of said de-
<br />ceased and that the time allowed creditors for filing claims has fully expired;that all
<br />claims outstanding against said deceased not sb filed,if any such there be are therefore for-
