<br />will and testament of said Wilhelm Marth,deceased;
<br />f'. that -the Court fixed the 24th day of August,1926,as the date for making proof of said will
<br />anddue notice of the filing of said petition and of the time and place fixed for hearing thereon
<br />wasIgiven by the Court in the manner provided by law,and on the 24th day of August,1926,bein
<br />the`date fixed for that purpose,said.instrument was duly proven,allowsed and admitted to probate
<br />in this Court as and for the last will and testament of the said Wilhelm Marth,deceased,and
<br />latters testamentary were duly issued thereon to the said Henry Marth,Executor,as named in ssid
<br />will,and he duly qualified-'a6 such.

<br />The 09tirt further finds that due and legal notice has been given to all persons of the i
<br />time and place fixed by the Court for the filing of claims against said estate,:&.nd that the
<br />time so fixed has fully expired,and that all persons having claims against said estate,if
<br />anysuch there be,are forever barred and excluded from setting up or asserting any such elaim�
<br />i
<br />against said estate.
<br />The Court further finds that said Wilhelm Marth,deceased,died seized as the owner in fee
<br />simple of the following described real estate situated in the county of Hall and state of
<br />i
<br />I
<br />Nebraska to-wit: .f
<br />North Half of the northwest quarter of Section Four (4),in Township Ten (10) North,Range
<br />Ten (10) best of the $th P.M. i
<br />Southwest quarter of the southwest quarter of Section Thirty -three (33),in Township Eleve#
<br />it
<br />(11) North,Range Ten (10) West of the 6th P.M.
<br />i
<br />Cemetery Lot Number 19A in Row 11 in the Grand Island Cemetery.
<br />That by the terms of the said last will and testament of said Wilhelm Marth,deceased,
<br />said real estate passed and descended to Henry Marth,subject to the payment of the following
<br />legacies,to -wit:
<br />Augusta Husen
<br />$1000.00
<br />Emma Marth
<br />1000.00
<br />Albert Marth
<br />1000.00
<br />William Marth
<br />1000.00
<br />Fred Marth
<br />1000.002
<br />and said legacies to constitute a lien upon said real estate until paid.
<br />The Court further finds that all debts and claims,funeral expenses,and expenses of ad- j

<br />ministering said estate,have been paid,and distribution of the residue of said estate has be4n
<br />made as by said will provided and that said estate is not subject to inheritance tax under t*e
<br />laws of the state of Nebraska,and nothing further belonging to said estate remains in the
<br />i!
<br />hands of said Executor.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of said
<br />Henry Marth,Executor of the last will and testament of said Wilhelm Marth,deoeased,be,and th$
<br />same is hereby approved and allowed as and for his final report,aaid estate is hereby settle
<br />and closed and said Executor is discharged and his bond as such is hereby released.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that under and by virtue of said last will
<br />and testament of said Wilhelm Marth,deceased,the absolute title to the following described
<br />real estate,to -wit:
<br />North half of northwest quarter of Section Four (4),in Township Ten (10) North,Range Ten'
<br />(10) West of the 6th P.M.
<br />Southwest quarter of the southwest quarter of Section Thirty -three (33),in Township Elevet

<br />situate in Hall County,Nebraska,passed and descended to Henry Marth,subject to the payment
