TH-11 MID DIE-Q-0-3-a � ��� �� <br />. -'(�Q 1 „_ THTE JO.0 RNAL COMPANY, LINCOLN, NEB. <br />-� _._ - �_s_.____. -•- <br />than thirty days and less than sixty days after the filing of said petition,and there being <br />no objections thereto,the cause was duly submitted to the Court upon Maid petition and the ti <br />evidence,and the Court,being duly advised in the premises,finds that the allegations of <br />said petition are true;that the said Mary Emma Culbertson died intestate on the 16th day of <br />February, 1914, in Hall County, Nebraska, and that at the time of her death she was a resident <br />i <br />of Hall County,Nebraska;that at the time of her death she was the owner of certain real <br />estate in Hall County,Nebraska;that more than two years have elapsed since her death;that no <br />application has been made in the state of Nebraska for the appointment of an administrator of` <br />her estate,and no administration has been had of said estate. <br />The Court finds that said deceased left her surviving the following named heirs at law- <br />i; <br />William H.Culbertson,widower,Nellie Mohr,a daughter,then 30 years of age,Minnie Hoagland, ,1 <br />a.daughter:,then 38 years of.age,and Carl R.Culbertson,a son-,then 33 years of age,and that <br />the said William H.Culbertson died in Hall County,Nebraska,on June 10,1926,and left surviving <br />him the above named Nellie,Mohr,Minnie Hoagland and Carl R.Culbertson,as his sole and only <br />heirs at law. <br />The Court further finds that Mary Emma Culbertson died seized in fee simple of the fol <br />described real estate situated in Hall County,Nebraska,to -wit: <br />Lot Four (4) in Block Fifteen (15),Russel Wheeler's Addition to the city of Grand Island, <br />Hall County,Nebraska, <br />which said real estate did,upon the date of the death of said Mary Emma Culbertson,pass and <br />descend,by operation of law,to the above named heirs at law as follows: <br />To William H.Culbertson,an undivided one -third interest; <br />and to each of the following,Nellie Mohr,Minnie Hpagland,and Carl R.Culbertson,an undivided <br />two- ninths interest each,subjeot to the right of homestead therein which passed to the said <br />William H.Culbertson,surviving widower of said deceased. <br />The Court further finds that said Mary Emma Culbertson held title to the aforesaid described <br />real estate under the name of Mary E.Culbertson. <br />i' <br />Toe Court further finds that no petition or application has been filed in the state of <br />•s <br />Nebraska for the appointment of an administrator of the estate of said deceased,and that no <br />administration has been had upon her estate in the state of Nebraska,and that more than two <br />ti <br />years have elapsed since her death,and that she died intestate,and that her funeral expenses i <br />f. <br />r. <br />have been paid;and that all the debts of said deceased and her estate have been paid and are <br />forever barred and precluded,and that the costs of this proceeding have been paid. <br />i <br />IT IS,THEREFORE,BY THE COURT CONSIDERED,ADJUDGED AND DECREED that the said Mary Emma Cul- <br />bertson d1ed intestate more than two years prior to the filing of the petition herein,that not <br />application for the appointment of an administrator of her estate has been made in the state,! <br />of Nebraska,nor has there been any administration upon her estate in the state of Nebraska, <br />and that she died seized in fee simple of the following described real estate situated in <br />Hail County,Nebra.ska,to -wit: Lot 4 in Block 15,in Russel Wheeler's Addition to the city of <br />Grand Island,Hall County,Nebraska;that she left her surviving,as her only heirs at law,Williamji <br />H.Culbertson,widower,Nellie Mohr,a daughter,Minnie Hoagland,a daughter,and Carl R.Culbertson, <br />a son,and that on the date:of her death said Nellie Mohr was of the age of 30 years,said MinnVe <br />Hoagland of the age of 39 years,and said Carl R.Culbertson of the -age of 33 years,and that <br />in Hall County,Nebraska <br />said William H.Culbertson died on the 10th day of June,1926Aand left surviving him as his <br />i <br />sole and only heirs at law,the above named,Minnie Hoagland,Nellie Mohr and Carl R.Culbertson <br />that.._the above described real estate passed and descended,upon the death of Mary Emma Culberts�oln, <br />as follows: To William H.Culbertemn,an undivided one -third interest;to Nellie Mohr,Minnie <br />
