<br />Hall County, At a session of the County Court held in the County Court Room in
<br />Grand Island,in said County,on the 8th day of September A.D.,1925.

<br />Fritz Spatholt,deceased.
<br />I,J.H.Mullin,Judge of the County Court in and for said County,do here-
<br />by certify that on the 12th day of August 1925,the instrument purporting to be the last
<br />will and testament of Fritz Spatholt,deceased,was filed for probate in this Court. That on
<br />the 8th day of September 192�,said instrument to which this certificate is attached was duly
<br />proved,probated and allowed as the last willand testament of the real and personal estate
<br />of said Fritz Spatholt,deceased,and the same was ordered t -o be recorded in the records of
<br />the Court aforesaid.

<br />FINAL DECREE.
<br />Fritz Spatholt,deceased.
<br />Now on this 24th day of February,1926,this cause came on to be heard upon the final report
<br />of William Loescher,executor of the last Will and Testament of Fritz Spatholt,deceased,and
<br />upon his petition for a settlement of said estate and his discharge herein,and the court hav-
<br />ing examined the records and files and being duly advised in the premises finds that due and
<br />legal notice has been given to all persons interested in said estate of the time and place
<br />fixed for a hearing upon said final report,as heretofore ordered by the Court.
<br />And no one appearing to object to said report,the Court examined the same together with
<br />vouchers on file and the testimony offered in support thereof,and being duly advised in the
<br />premises the Court finds that said report is true and correct in all things and that same
<br />ought to be allowed and approved as and for the final report of said executor.
<br />The Court further finds that Fritz Spatholt departed this life,testate,on the 27th
<br />day of July,1925,and at the time of his death the said Fritz Spatholt was a resident and
<br />inhabitant of Hall County,Nebraska.
<br />The Court further finds that on the 8th day of August,1925,hydia Frauen,a daughter of
<br />said deceased,filed in this Court her petition duly verified praying for the allowance and
<br />probate of an instrument purporting to be the last Will and Testament of the said Fritz Spat -I
<br />holt,deceasedthat the court thereupon fixed the 8th day of September,1925 as the day for
<br />making proof of said Will and Testament and due notice of the filing of said petition and
<br />of the time and place fixed for hearing thereon was given by the Court in the manner provided
<br />by law and that on the 8th day of September,said instrument was duly proverl,allowed and ad-
<br />mitted to probate in this Court as and for the last Will and Testament of the said Fritz
<br />Spatholt,deceased.
<br />The Court further finds that on said day,to -wit; the 8th day of September,1925,the widow,
<br />�i Charlotte Spatholt,named in said last Will and Testament as the executrix declined the
<br />appointmdn.t because of infirmities and filed her petition in this Court requesting the
