0 <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA. <br />In the matter of the estate <br />of Earl Linn, DECREE. <br />Deceased. <br />Now,on this 9 day of December,1926,this cause came on for hearing upon the petition of <br />Clara Linn,mother and heir at law of the above named Earl Linn,deoeased,praying for settle-. <br />ment of the estate of said deceased,a determination of his heirs and the right of descent <br />of his real estate and degree of kinship of said heir at law,and it appearing from the proof <br />on file herein that due and legal n6tioe by publication for three successive weeks as by <br />law and the order of this Court required has been given to all creditors,heirs at law,and <br />persons interested in said estate of the filing of said petition and of the time and place <br />for hearing same,which time was more than thirty days and less than sixty days after the. <br />filing of said petition,and there being no objections thereto,the cause was duly submitted <br />to the Court upon said petition and the evidence and the Court,beiig duly advised in the <br />premises,finds that the allegations in the petition are true that said Earl Linn died,in- <br />testate,on the 27th day of Maroh,1913,and at the time of his death was a resident of Hall <br />County,Nebraska,and that at the time of his death he was the owner of an interest in cer- <br />tain real estate in Hall County,Nebraska;that more than two years have alapsed since his <br />death and that no application has been made in the state of Nebraska for the appointment <br />of an administrator of his estate and no administration has been had of said estate. <br />The Court finds that the deceased left him surviving his mother,Clara Linn,the petitioner, <br />as his sole and only heir at law. <br />The Court further finds that said Earl Linn died seized as the owner of an undivided <br />two - ninths interest in the following described real estate: Lots Six (6) and Seven (7) in <br />Garden Place, a sub- division of part of the northwest quarter of Section Three (3),in Town- <br />ship Eleven (11) North,Range Nine (9) West of the 6th P.M.,in Hall County,Nebraska,subjeot <br />only to the homestead estate therein of the said Clara Linn,which interest in said real es- <br />tate did,upon the date of the death of said Earl Linn,pass and descend by operation of law <br />to his mother,Clara Linn. <br />The Court further finds that no petition or application has been filed in the state of <br />Nebraska for the appointment of an administrator of the estate of said deceased and that no <br />it administration has been had upon his estate in the state of Nebraska,and that more than two <br />years have alapsed since his death and that he died intestate,and that his funeral expenses <br />have been paid,and that all the debts of said deceased and his estate have been paid and <br />are forever barred and precluded,and that the costs of this proceeding have been paid. <br />IT IS,THEREFORE,BY THE COURT,IXDJUDGED,CONSIDERED AND DECREED that the said Earl Linn <br />died intestate more than two years prior to the filing of the petition herein ;that no appli- <br />cation for the appointment of an administrator of his estate has been.,4made in the state of <br />Nebraska,nor has there been any administration upon his estate in the state of Nebraska,and <br />G <br />that he.died seized of an undivided two - ninths interest in and to the following described <br />real estate; Lots 6 and 7 in Garden Place, a subdivision of part of the northwest quarter of <br />i1 Section 3,in Township 11 North,Range 9 West of the 6th P.M.,in Hall County,Nebraska,subject <br />II ii <br />only to the homestead estate therein of the said Clara Linn,and that he left surviving <br />him,as his sole and only heir at law,his mother,Clara Linn,and the same is hereby awarded to <br />her as provided by the laws of descent of the state of Nebraska;that all of the debts of said <br />estate are paid or forever barred and precluded and that further administration of his estate <br />is here-by dispensed with anti _. i -- -sta e i s he by -- -- <br />J.H.Mul6ionnty Judge. <br />l� _ - <br />
