<br />Wind.nagel, and the sum of Three Thousand Dollars ($3000.00) was bequeathed to Joseph Windnagol,
<br />a stew -son of the deceased;One Thousand Dollars ($1000.00) to Friedrich Windnagel,a lbrother
<br />of the deceasedthree Hundred Dollars ($300.00) to Rosine Klenk,a sister of the d eceased,and
<br />Three Hundred Dollars ($300.00) to Goth l.f Windnagel,a brother of the deceased,and that all
<br />of the r est,residue and remainder aLf his property was devised and bequeathed unto his daughtex
<br />Bertha Scherzberg,formerly Bertha Salzbrytnn.
<br />The court finds that all of the legacies mentioned in said will and in the codicil thereto,
<br />have been fully paid and satisfied.
<br />The court further finds that the deceased was the owner in fee at the time of his death
<br />of Lots One (1),Two,(2),and Three (3) in Block Thirteen (13) of Arnold and Abbott"'s Addition
<br />to the City of Grand Island,Nebraska,and the South Half (SJ of Lot Five (5) in Block leventy
<br />eight (78) of the Original Town,now City of Grand Island, Nebraska, and in addition thereto
<br />was the owner of eighty acres of land in Fort Bend County, Texas, described in the deed recorded
<br />in Volume 62 at Page 388 of the Deed Records of Fort -Bend County,Texas;and was the owner of ofte
<br />t
<br />hundred acres of land in Houston County,Texas,and a lot in the town of Beasley,Texas;and
<br />was the owner of a contract for the purchase of the North Half of the East Half (NJ FJ) of Block
<br />Eight (8) of Windolph's Addition to the City of Grand Island,Nebraska,on which contract the de-
<br />ceased had paid the sum of One Thousand Dollars ($1000.00);and that according to the provisions
<br />of said last will and testament,all of said real estate passed and descended to Bertha Scherzi erg.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that according to the provisions of the last
<br />will and testament of Jacob Windnagel,deceased,Lots One (1),Two (2) and Three (3) in Block
<br />Thirteen (13) of Arnold and Abbott's Addition to the City of Grand Island,and the South Half
<br />(Sj) of Lot Five (5) in Block Seventy -eight (79) of the Original Town,now City of Grand Island,
<br />Nebraska,and the contract for the purchase of the North Half of the East Half (NJ EJ)of Block'
<br />Eight (S) of Windolph's Addition to the City of Grand Island,Nebraska,as also the real estate;
<br />owned by the deceased in Houston County,Texas,and Fort Bend County,Texas,o.nd
<br />in the Town of Beasley Texas,passed and descended to Bertha Scherzberg in fee,together with all
<br />of the personal property listed in the inventory which remained after the payment of the leg
<br />acies and th6. debts of the deceased and the same is hereby awarded to the said Bertha Scherz
<br />berg to have and to hold to her and her heirs forever.
<br />The court further finds that the said executrix has paid all inheritance taxes due the
<br />United States Government and the State of Nebraska,and that there is ina further tax due on account
<br />of inheritance or estate tax.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that said estate beclosed,the executrix dis-
<br />charged and her bond released.

<br />is in due form of law.
