<br />was duly submitted to the court on said petition and the evidence of the petitioner in
<br />support thereof,and the court being duly advised in the premises,finds that the allegations
<br />in said petition are true;that the said Matilda Gosgriff died intestate in Hall County,Nebras4a,
<br />on the 2nd day of January,A.D.1924,and at the time of her death,she was 51 years of age,and a�re-
<br />sident and inhabitant of Hall County,Nebraska;that more. than two years have elapsed since her:
<br />death and no application has been filed in the State of Nebra,ska,or elsewhere for the appointment
<br />of an administrator of her estate,nor petition filed therefor and that no administration has
<br />been had upon her estate at any place.

<br />The Court finds that the said deceased left surviving her as her sole and only heirs -at -law
<br />the following named persons,to -wit:
<br />Byyan Cosgriff,her surviving husband of Hall County,Nebra_ska;
<br />John P.Cosgriff,a son,of Hall County,Nebraska,being more than 21 years of age;
<br />Stanley G.Cosgriff,a son,of Hall County,Nebraska,being 20 years of age;
<br />Bernice J.Cosgriff,a daughter,of Hall County,Nebraska,being 11 years of age;
<br />that said deceased died seized as the owner of an estate of inheritance in and to the following
<br />described property situated in Hall County,Nebraska,to -wit:
<br />An undivided one - fourth interest in and to the Southwest Quarter (SWJ) of Section Twenty -six
<br />(26),in Township Ten (10),North,Range Nine (9),West of the 6th P.M.in Hall County,Nebraska,
<br />subject to the life estate of the mother of the said Matilda Cosgriff,one Anna Mary Wortman.
<br />That said real estate,did on the death of said Matilda Cosgriff,pass and descend by operation
<br />of law under the law of descent in fc,ce in the State of Nebraska,to the said Bryan Cosgriff,
<br />surviving husband,John P.Cosgriff,Stanley G.Cosgriff,and Bernice J.Cosgriff,surviving children,
<br />as follows: To the said Bryan Cosgriff,an undivided one - =third part thereof;4nd to each of the!.
<br />above mentioned children,an undivided two - ninths interest therein.
<br />The Court finds that more than two years have elapsed since the death of the said deceased;
<br />that she died intestate and that her funeral expenses and all other debts have been fully paid
<br />and that all claims or debts of said estate and said deceased,if any exist,are forever barred',
<br />and precluded and the costs of these proceedings have been paid in full.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the said Matilda Cosgriff died intestate,
<br />as above stated more than two years prior to the filing of the petition in this cause;that no
<br />application for the appointment of an Administrator of her estate has ever been made nor has
<br />t( any administration upon her estate been had in the State of Nebraska or any other place;that
<br />she died seized as the owner of an estate of inheritance in the real estate above described,st-
<br />uated in Hall County,Nebra.ska,and upon her death the same passed and descended by operation
<br />of law to the following named,'oeing her surviving husband and sons and daughter,and the sole
<br />and only heirs -at -law of said deceased,to -wit:
<br />Bryan Cosgriff,surviving husband of said deceased;
<br />John P.Cosgriff,surviving son
<br />Stanley G.Cosgriff,surviving; son
<br />Bernice J.Cosgriff,surviving daughter
<br />To the said Bryan Cosgriff,an undivided one -third part thereof in fee,and to John P.Cos-
<br />griff ,Stanley G.Cosgriff and Bernice J.Cosgriff,ea,ch an undivided two- ninths interest therein',
<br />in fee,and all subject to the life estate of the motherof said estate,Anna Mary Wortman,above
<br />mentioned,and said estate is so awarded the them.
<br />The said deceased left surviving her as her sole and only heirs- at- law,the above named
<br />Bryan Cosgriff,surviving husband of said deceased,John P.Cosgriff,a son,Stanley G.Cosgriff,a
<br />son and Bernice J. Cosgriff,a daughter,who bore the relationship to her as above set forth
