<br />in support of said petition and being fully advised in the premises,finds that the allega-
<br />tions of said petition are true and that the said Eliza Weavers departed this life intestate
<br />onthe 20th day of April,1$84,and that at the time of her death she was a resident and inhab-
<br />itant of Hall County,Nebraska,and that she departed this life in said county;that more than
<br />two years have elapsed since the death of the said Eliza Weavers,deceased,and that no applica-
<br />tion or other petition has ever been filed in the stateof Nebraska for the appointment of an
<br />administrator of her estate,and no administration of her estate has ever been had in the state
<br />of Nebraska;that the mother and father of said Eliza Weavers preceded her in death;that the
<br />said Eliza Weavers was never married and was never the motherof any child or children,and
<br />that she left surviving her,asher heirs at law and her only heirs at law,the following named
<br />persons;George Weavers, brother of the full- blood,and Henry N.Martin,being the petitioner
<br />herein,Robert O.Martin,William E.Martin,Anna Hoffman,and Hepzibah Masterson,brothers and
<br />sisters of the half- blood,they being sons and daughters of George Martin and Ann Martin,
<br />husband and wife,said Ann Martin formerly being Ann Weavers,the wife of George Weavers,and
<br />who intermarried with George Martin after the death of said George Weavers;that said Eliza
<br />Weavers died seized as the owner,by fee simple title absolute,of the following described
<br />real estatesituated in the county of Hall and state of Nebraska,to- wit;the north half of the

<br />southeast quarter of Section Twelve (12),Township Nine (9) North,Range Eleven (11) West of
<br />the 6th P.M.,and that upon the death of said Eliza Weavers the real estate above described
<br />passed and descended,under the intestate laws of the state of Nebraska in force at the time
<br />16f the death of the said Eliza Weavers,to George Weavers,a brother of the full- blood,and

<br />Henry N.Martin,Robert O.Martin,William E.Martin,Anna Hoffman,and Hepzibah Masterson,brothers
<br />and sisters of the half -blood by absolute title,share and share alike;that the petitioner,
<br />Henry N.Martin,at the time of filing the petition herein,was the owner of the real estate

<br />i` herein described,and was a competent and proper person to prosecute this proceedirg;that
<br />it the funeral expenses of said deceased and the debts of said deceased and the costs of this
<br />proceeding have been fully paid,and if any debts existed against said estate,the same have
<br />long since been barred by the statute of limitations of the state of Nebraska,and that the

<br />petitioner herein is entitled to a decree as prayed in said petition.
<br />IT #S, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Eliza Weavers de-
<br />parted this life,intestate,on the 20th day of April,1$94,in Hall County,Nebraska,and that
<br />at the time of her death said Eliza Weavers was a resident and inhabitant of the county of
<br />Hall in the state of Nebraska-that more than two years have elapsed between the death of the
<br />said Eliza Weavers arA the filing of the petition herein;that no application or petition has
<br />ever been filed for administration upon the estate of the said deceased in the state of Neb-
<br />ii has the estate of said deceased ever been administered upon;that said Eliza Weav-
<br />ers left surviving her,as her heirs at law,and her only heirs at law,George Weavers,a brother
<br />of the full - blood,and Henry N.Martin,the petitioner herein,Robert O.Martin,William E.Martin,
<br />Anna Hoffman,and Hepzibah ha.sterson,brothers and sisters of the half - blood,all of whom are
<br />of lawful age ;that said Eliza Weavers died seized as owner,by fee simple title absolute,
<br />of the real estate hereinbefore described,and that upon her death the same passed and des -
<br />cended,under the intestate laws of the state of Nebraska in force at the time of the death
<br />of the said Eliza Weavers,to George Weavers,a brother of the full- blood,and Henry N.Martin,
<br />Robert O.Martin,William E.Martin,Anna Hoffman,and Hepzibah Masterson,brothers and sisters
<br />of the half- blood,by absolute title,share and share alike;that the petitioner,Henry N.Martin,
<br />at the time of filing the petition herein,was the owner of the real estate hereinbefore des-
<br />cribed and was a nompetent and proper person to prossecute this proceeding for the purpose
